AN ORDINANCE CLOSING A PORTION OF BLUEGILLAVENUE BETWEENWALDRON <br />AVENUE AND GREENWOOD DRIVE (S-72-I1). <br /> <br /> WHEREAS, Mr. and Mrs. A. J. Stewart and Mr. and Mrs. <br />John W. Sedberry have made application to vacate, close and <br />discontinue the hereinafter described portion of Bluegill <br />Avenue; and <br /> <br /> WHEREAS, by resolution of this Council, adopted June <br />12, 1973, viewers were appointed pursuant to Section 15.1-364 <br />of the Code of Virginia, 1950, as amended, to view the here- <br />inafter portions of the said street and to report in writing <br />whether in their opinion, any, and if any, what inconvenience <br />would result from discontinuing the below described street; <br />and <br /> <br /> WHEREAS, the said vieWers have reported in writing <br />that in their opinion no inconvenience would result from closing <br />and discontinuing said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia, that that portion of Bluegill Ave- <br />nue hereinafter described, be closed and vacated as a public <br />street. <br /> <br /> Ail that certain piece or parcel of land <br />lying and being in the'City of Portsmouth, <br />Virginia, and being that portion of Blue- <br />gill Avenue, formerly First Street, located <br />between the southern right of way line of <br />Waldron Avenue and the northern right of way <br />line of Greenwood Drive, which street is ap- <br />proximately 20 feet wide and 217 feet long <br />and is in an unimproved condition; <br /> <br /> AND BE IT FURTHER ORDAINED that the whole of such portion <br />of Bluegill Avenue hereinabove described shall be subject to an <br />easement retained in favor of the City of Portsmouth for the con- <br />struction, maintenance and repair of storm drain facilities. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held July 24, 1973. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
