l~ 1973-83 <br /> <br />AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, BY AMENDING CERTAIN SECTIONS OF CHAPTER 19 OF SAID CODE, <br />SUCH A~LENDED SECTIONS PERTAINING TO DISORDERLY HOUSES AND COM~ON <br />~JISANCES; BINGO AND LOTTERIES; AND ADDING A NEW SECTION T~RETO <br />CONCERi~ING ATTF~PTS TO VIOLATE DRUG ABUSE ORDINANCES. <br /> <br /> WHEREAS~ the City of Portsmouth is authorized to en- <br />act as ordinance~ certain statutes from the Code of Virginia, <br />provided such ordinances are substantially consistent with the <br />state law; and <br /> <br /> ~EREAS, the General Assembly of Virginia at its 1973 <br />session amended certain of those statutes of the Code of Virginia, <br />1950; and <br /> <br /> WHEP~EAS, it is therefore necessary to amend a certain <br />chapter of the Code of the City of Portsmouth, Virginia, 1961, <br />so as to make said chapter conform to the changes in the Code <br />of Virginia enacted by the General Assembly at its 1973 session. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. ThKt ~che Cod~ of~t~e~i~f-~ortsmo~h, V-irgi~ia, <br />1961, be amended by amending certain sections of Chapter 19 and <br />adding thereto a new section, such new and amended sections to <br />read as follows: <br /> <br />Section 19-13.3. Attempts to violate Section 19-13.1. <br /> <br /> Any person who attempts to violate the provisions of <br />Section 19-13.1 shall be confined in jail not to exceed six <br />months or fined no more than five hundred dollars or both. <br /> <br />Section 19-19.1. Certain premises deemed common nuisance. <br /> <br /> (a) .Any office, store, shop, restaurant, dance hall~ <br />theater~ poolroom, clubhouse, storehouse, warehouse, dwelling <br />house, apartment, building of any kind, vehicle, vessel, boat, <br />or aircraft which ~ith the knowledge of the o~er, lessor, agent <br />of any such lessor, manager, chief executive officer or operator <br />thereof, is frequented by persons under ~the influence of illegally <br />obtained controlled substances, as defined in Section 54-524.2, <br />Code of Virginia (1950), om for the purpose of illegally obtaining <br />possession of, manufacturing or distributing controlled substances <br />or which is used for the illegal possession~ manufacture of distri- <br />bution of controlled substances~ shall be deemed a common nuisance. <br />It shall be unlawful for such o~%er, lessor, agent of any such <br />lessor~ manager~ chief executive officer or operator to know- <br /> <br /> <br />
