amount of such accumulated contributions is less than ten dollars, <br />no such payment shall be made. <br /> <br />Section 26-38° Ordinary death benefits. <br /> <br /> (a) Should a member, who had one or more years of <br />creditable service, die in service at any time before retirement <br />from a cause not compensable under the Virginia Workmen's Com- <br />pensation Act, an ~dditional benefit equal to one thousand dollars <br />shall then be payable in a "l~p sum in accordance with section 26-42. <br /> <br /> (b) Should a member die in service at any time after <br />having attained his fifty-fifth birthday, from a cause not com- <br />pensable under the Virginia Workmen~s Compensation Act, there <br />shall be paid a retirement allowance to the first of the follow- <br />ing listed persons, if any, who is a!ive at the death of the member: <br />wife~ husband, mother~ father~ sister or brother~ provided such <br />sister or brother received more than fifty percent of her or his <br />support from the member. Such retirement allowance shall be pay- <br />able during the lifetime of such first listed person and shall be <br />equal to the reduced retir~ent allowance that would have been <br />payable from tim~ to time ha~.the member retired on the date of <br />his death after having electe~ to have his allowance payable under <br />the joint and last survivor option described in subsection (a) <br />of section 26-41 so that the same amount would be oontinued after <br />his dea~% to such first listed person. <br /> <br />Section 26-~0~ Deat/a benefits after retirement or disability. <br /> <br /> (a) should a member who retired prior to July 1, 1967, <br />die at any time after retirement but before receiving total retire- <br />ment allowances provided in this chapter at least equal to his ac- <br />cumulated contributions as of his date of retirement, the differ- <br />ence between such accu~lated contributions and such total allow- <br />ances shall then be payable in a lump sum in accordance with section <br />26-42~ unless the retirement allowance is then being paid in accord- <br />ance with any of the options contained in section 26-41~ as in ef- <br />fect at his date of retirement. <br /> (b) Should a member who had at least one year of cre- <br />ditable service die after t~rmination of service and before his <br />normal retirement date~ after having been continuously disabled <br />from date of termination of service to date of death to such an <br />extent that he would have qualified for disability retirement in <br />accordance with section 26-33 or section 26-35, without regard to <br />any creditable service requirements or actual retirement there- <br />under, provided that written notification of such disability i~ <br />given to the board by the member, his employer or his beneficiary <br />designated as provided in section 26-~2 within one year after the <br />member's te~..~ination of servlce~ an additional benefit equal to <br />one thousand dollars shall be payable in a lump sum in accordance <br /> <br /> <br />
