(c) The compensation finally awarded to the member <br />under the Virginla Workmen's Compensation Act shall be deducted <br />from any allowance becomingg payable under the provisions of this <br />section~ and the excess of the allowance, if any, shall be paid <br />to t~he member. ~en the time for payments of compensation under <br />such act has elapsed~ the member shall thereafter receive the <br />full amount of such allowance payable monthly during his lifetime <br />and continued disability. <br /> <br />Section 26-36.1.- Additional allowance. <br /> <br /> Any person receiving a retirement allowance under section <br />26-32~ 26-3&~ 26-36, 26-35(b) or 26-41 shall receive an additional <br />allowance to reflect any adjustments in the United States Average <br />Cons~er Price Index for all items~ as published by the Bureau of <br />Labor Statistics of the United States Department of Labor, that <br />may have taken place since the m~ber's death or retirement~ which- <br />ever first occurred° Such additional allowance shall be determined <br />as a percentage of the retirement allowance that would have been <br />payable in the absence of this section and shall be subject to the <br />same ccnditions of payment as are applicable to such retirement al- <br />iowance~ with such percentage being computed as the percentage in- <br />c~ease in said Consumer Price ~ndex from its monthly average for <br />the calendar year in which the me~er~s death or retirement occur- <br />red to its monthly average for the calendar veer i~ediately prior <br />to the calendar year as of which the amount of the additional al- <br />lowance is being determined. Any additional allowance provided <br />under this section shall be determined on a fiscal year basis only, <br />as of each July it and no such additional allowance shall be paid <br />to any person prior to the July 1 next following the expiration of <br />a period of twelve months after the end of the calendar year in <br />which took place the member's death or retirement, whichever first <br />occurred. In no case shall the operation of this section result <br />in a reduction in the amount of any person's total benefit below <br />the amount of the retirement allowance ~hat would have been pay- <br />able in the absence of this section. <br /> <br />Section 26-37. Refund of accumulated contributions. <br /> <br /> (a) Upon the retirement of a member or upon his termi- <br />nation of service as an employee, other than by death~ he shall be <br />paid, on demand, but not later than ninety days thereafter, the <br />amount of his accum~alate~ contributions~ if any, in a l~p sum; <br />provided that if the amount of such accumulated contributions is <br />less than ten doilars~ no such pa~ent shall be made. <br /> <br /> (b) Should a member die at any time while in service, <br />the amount of his accumulated contributions shall be paid in a <br />lump s~m in accordance with section 26-~2; provided that if the <br /> <br /> <br />
