Section 26-34. Ordinary disability retirement allowance. <br /> <br /> (a) Upon retirement as provided ~n section 26-33, on <br />or after July 1, 1973, a member shall receive an annual retire- <br />ment allowance, payable monthly to him during his lifetime and <br />continued disability, in an amount determined as follows: <br /> <br />(1) <br /> <br />With respect to any allowance payment fall- <br />ing due before the me~£Der's normal retire- <br />ment date and in a month for which the member <br />is not entitled to total and permanen~ dis- <br />ability benefits under the Social Security <br />Act, two percent of his average final com- <br />pensation multiplied by the number of years <br />of his "disability-credited service", as <br />hereinafter defined. <br /> <br />(2) <br /> <br />With respect to any allowance payment fall- <br />ing due before the member's normal retire- <br />ment date and in a month for which the member <br />· s entitled to total and permanent disability <br />benefits under the Social Security Act, the <br />larger of: (i) One percent of his average <br />final compensation multiplied by the number <br />of years of his "disability-credited service"; <br />or (.ii) The excess of (x) two percent of his <br />average final compensation multiplied by the <br />number of years of his "disability-credited <br />service" over (y) two percent of the annual <br />amount of the primary total and permanent <br />disability benefit under the Social Security <br />Act to which the member first became entitled <br />multiplied by the number of years of his <br />"disability-credited service", not in excess <br />of twenty-five such years. <br /> <br />(3) <br /> <br />With respect to any allowance payment falling <br />due after the member's normal retirement date, <br />the larger of: (i) One percent of his average <br />final compensation multiplied by the number of <br />years of his "disability-credited service"; or <br />(ii) The excess of (x) two percent of his <br />average final compensation multiplied by the <br />number of years of his "disability-credited <br />service" over (y) two percent of the annual <br />amount of the primary total and permanent dis- <br />ability benefit or the primary old-age benefit <br />at age sixty-five to which the member first <br />became entitled, multiplied by the number of <br /> <br />-10- <br /> <br /> <br />
