(c) Upon retirement as provided in subsection (¢) of <br />section 26-31, on or after July 1, 1973, a m~mber shall re- <br />ceive an annual retirement allowance payable monthly to him dur- <br />ing his lifetime the amount of which, before and after his normal <br />retirement date, shall be determined in accordance with either <br />subsection (a) or subsection (b) of this section, whichever is <br />applicable, except that if the member has completed less than <br />twenty years of creditable servlce, the allowance as computed <br />shall be reduced to a percentage of itself an accordance with <br />the following table: <br /> <br />Complete Years of <br />Credited Service <br /> <br />Applicable <br />Percentage <br /> <br />Ten but less than eleven <br />Eleven but less than twelve <br />Twelve but less than thirteen <br />Thirteen but less than fourteen <br />Fourteen but less than fifteen <br />Fifteen but less than sixteen <br />Sixteen but less than seventeen <br />Seventeen but less than eighteen <br />Eighteen but less than nineteen <br />Nineteen but less than twenty <br /> <br />50% <br />55% <br />6O% <br />65% <br />70% <br />75% <br />8O% <br />85% <br />90% <br />95% <br /> <br /> (d) The foregoing provisions to the contrary notwith- <br />standing, if a member's retirement allowance is payable under one <br />of the options of section 26-41, the amount~and duration thereof <br />shall be determined in accordance with the provisions of the ap- <br />plicable option. <br /> <br />Section 26-33. Ordinary disability retirement. <br /> <br /> Any member an service who has five or more years of cre- <br />ditable servlce may, at any time on or after July 1, 1973, and <br />before his normal retirement date, retire on account of disability <br />not compensable under the Virginia Workmen's Compensation Act upon <br />written notification to the board made by the member or his em- <br />ployer, setting forth at which time the retirement is to become <br />effective; provided, that such effective date shall be after the <br />last day of service but shall not be more than ninety days prior <br />to the date of such notification; and provided further, the ex- <br />aminer, after a medical examination of such member, shall certify <br />(i) That such member is, and has been continuously since such ef- <br />fective date, if prior to the filing of such notice, mentally or <br />physically incapacitated for the further performance of duty. <br />(ii) That such incapacity is likely to be permanent. (iii) That <br />such member should be retired. <br /> <br />-9- <br /> <br /> <br />
