AN ORDINANCE CLOSING A PORTION OF PHILLIPS AVENUE 9~ST OF WATSON <br />STREET. <br /> <br /> WiiEREAS, Portsmouth Redevelopment and Housing Au~aority <br />has made application to vacate~ close and discontinue the herein- <br />after described portion of Phillips Avenue; and <br /> <br /> WHEREAS, by resolution of this Council, adopted Feb- <br />ruarv 12, 1974, viewers were appointed pursuant to Section <br />15.1-364 of the Code of Virginia (1950) as amended, to view the <br />hereinafter described portion of the said street and to report <br />in writing whether in their opinion, any, and if any, what <br />inconvenience would result from discontinuiD~ the below described <br />street; and <br /> <br /> WHEREAS, the said viewers have reported in writing <br />that in their opinion no inconvenience would result from closing <br />and discontinuing said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED bv the'Council of the <br />City of Portsmouth, Virginia, that that ~ortion of Phillips <br />Avenue hereinafter described, be closed and vacated as a public <br />street. <br /> <br /> Ail that certain piece or earcel of land <br />lying and being in the City of Portsmouth, Vir- <br />ginia, and comprzsing the dead end portion of <br />Phillies Avenue located west of Watson Street. <br /> <br /> AND, BE IT FURTHER ORDAINED that the whole of the por- <br />tion so closed shall be expressly subject to an easement reserved <br />unto the City of Portsmouth for the construction, maintenance <br />and repair of water mains, sewer mazns, gas mains and storm drainage <br />facilities. <br /> <br /> This ordinance shall take effect from the date of its <br />passage. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held March 26, 1974. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
