AN ORDINANCE TO A~iEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1973~ BY REPEALING SECTIONS 37-33 AND 37-53 THEREOF PER- <br />TAINING TO SOLICITATION O~ TAXICAB PATRONAGE AND TkANSFERABILITY <br />OF CERTIFICATES OF PUBLIC CONVENIENCE; BY ~%~L~iNG SECTION 37-1 <br />PERTAINING TO OFFENSIVE LANGUAGE OF TAXI~&B OPERATORS; BY At4EN~- <br />ING SECTION 37-28 THEREOF PERTAINING TO DESIGNATION OF TAXICAB <br />STANDS; BY AMENDING SECTION 37-56 PERTAINING TO REVOCATION OF <br />CERTIFICATES OF PUBLIC COi~AZENIENCE; AND BY AMENDING SECTION <br />37-80 PERTAINING TO USE OF TAXIMETERS. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth~ Virginia that: <br /> <br /> 1. The Code of the City of Portsmouth, Virginia, 1973 <br />be amended by repealing Sections 37-33 and 37-53 thereof. <br /> <br /> 2. The Code of the City of Portsmouth, Virginia; <br />be amended by amending Sec%ions 37-1, 37-28~ 37-56 and 37-80 <br />thereof, such amended sections to read as follows: <br /> <br />1973, <br /> <br />Section 37-1. Use of offensive language by operator. <br /> <br /> If any insulting~ offensive~ obscene~ profane or <br />threatening language is used toward or in the presence of any <br />passenger by the driver or operator of an automobile or other <br />vehicle transporting passengers for pay, the court or jury try- <br />mug the offense may, in addition to imposing the general penalty <br />provided for in Section 1-9 of this Code, declare the license <br />or permit o~ such person revoked. <br /> <br />Section 37-28. Designation of stands, parking spaces. <br /> <br /> The city manager shall designate the stands or parking <br />places for taxicabs and shall assign spaces to the operator there- <br />of. At least two (2) taxicab parking spaces shall be designated <br />in that portion of the city lying north of the Western Branch <br />of the Elizabeth River. <br /> <br />Section 37-56. Grounds for revocation~ suspension. <br /> <br /> (a) Any certificate of public convenience and <br />necessity issued under this division may be suspended by the <br />city manager for a period of ninety (90) days for any of the <br />following grounds: <br /> <br /> 1) Failure to operate a taxicab as specified <br />in the certificate or permit. <br /> <br />2) Failure to maintain a taxicab in good order, <br /> <br /> <br />
