AN ORDiNAnCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- GINIA, 1973, BY ADDING TF~RETO A NEW C~PTER NUMBERED 40.1 PERTAINING TO FLOOD CONTROL ?~LANAG~4ENT. Be it ordained by the Council of the City of Ports- mouth, Virginia~ that the Code of the City of Portsmouth, Vir- ginia, 1973, be amended by adding thereto a new chapter nu~er- ed 40.1, such chapter to be known as the Flood Control Ordinance of the City of Portsmouth and to read as follows: Section 40.1-1. Purposes of tb~s chapter. The purposes of this cha~ter are to control certain flood plain uses which would, either alone or in combination wi~h other uses, cause damaging flood heights and velocities by obstructing flows and reducing valley storage; protect human life and health; minimize damage to public and private property; discourage the ~urchase of land where the intended use is un- suitable due to-flood hazards; mmnimize surface and ground water pollution; control development which directly or indirectly creates an unjustified demand for public investment in flood control works by requiring uses vulnerable to floods to be protected against floods at the tzme of initial construction; control development which would, directly or indirectty~ cause flood losses if public streets~ sewer~ water and other utilities must be extended below the flood level to serve the develo~ent: control deve!o~ent which would, directly or indirectly, create an additional burden to the public to pay the cos~ of emergency flood-fighting measly_res; provide for public awarness of flooding potential; and assist mn maintaining a stable tax base by preservation or enhancement of property values for future flood-plain development. Section 40.1-2. Application of this chapter; the Zoning Map of the City of Portsmouth. (a) This chapter shall apply to all lands within the City of Portsmouth which are shown on the Zoning Map of the City of Portsmouth to be located within Flood Hazard District ! or (FH-1) or Flood Hazard District 2 (FH-2). The Zoning MaD of the City of Portsmouth shall consist of those map sheets adopted by Section 40-!8 of this Code plus a!l map sheets which accompany this ordinance and which depict flood hazard districts thereon. In the application of zoning laws within the City, the Zoning Map as heretofore constituted a~d those map sheets which depzct flood hazard districts shall be read and construed together.
