AN ORDINANCE CLOSING A PORTION OF MILITARY ROAD NORTH OF VICTORY BOULEVARD . (S-75-5) WHEREAS, KBN, Inc. has made application to vacate, .close and discontinue the hereinafter described portion of Military Road; and WHEREAS~ by resolution of this Council~ adopted May~ 28, 1974, viewers were appointed pursuant to Section 15.1-364 of the Code of V~rginia (1950), as amended, to view the here- inafter described ~portion of the said street, and to report in writing whether, in their opinion, any, and if any, what incon- venience would result from discontinuing the below described street; and WHEREAS, the said viewers have reported in writing that, in their opinion, no inconvenience would result from closing and discontinuing said street. NOW, THEREFORE, BE IT ORDAINED .by the Council of the City of Portsmouth, Virginia, that that portion of Military Road hereinafter described, be closed and vacated as a public street. Beginning at the southwest intersection of Victory Boulevard and Military Road; thence northwesterly along the southerly line of Mili- tary Road North 41°43'00'' West 128.17 feet; thence North 48°17'27" East 30 feet, more or less, to the northerly line of b~litary Road; thence South 41°43'00" East along the north- erly line of Military Road to the northeast intersection of Victory Boulevard and Military Road; and thence North 85~45'00~ West across Military Road to the point of beginning; it being the portion of Military Road contiguous with Parcel 18 on Plate 487 on the Tax Maps of the City of Portsmouth. AND, BE tT FURTHER ORDAIneD that tha whole of the portion so closed shall be expressly subject to an easement reserved unto the City of Portsmouth for the construction, maintenance and re- pair of water mains, sewer mains, gas mains and storm drainage facilities.
