(a) A nonconforming use or building legally in <br />existence prior to Septel~er 23, 1971, within the Historic <br />District may apply to the boar~ of zoning appeals for per- <br />mission to expand such use. ~ere such expansion entails <br />ten©ration, remodeling, rehabilitation or other form cf <br />structural change, plans, drawings and engineering data <br />shall be submitted to the Dui!ding Official and the comm- <br />ission of ~chitectura! Review for review and approval <br />strictly in accordance with the principles and procedures <br />established elsewhere in this article. <br /> <br /> (b) If the application is deemed eligible for a <br />Certificate of Appropriateness from the commission of <br />Architectural Review and is otherwise qualified under <br />building, plumbing, electrical, gas and other pertinent <br />codes, the board of zoning appeals shall proceed to deter- <br />mine whether a special exception shall'be granted allowing <br />such nonconforming use to expand. No such exception shall <br />be granted unless the board finds that such recuested ex- <br />ception would not be injurious to the neighborhood, that <br />denial would create severe and undue hardship for the <br />applicant, and that denial of the application will result <br />an no appreciable benefit to the neighborhood. In passlng <br />on such application, the board shall strictly adhere Go the <br />principles and procedures set forth in Article 8 of Chapter <br />11 of Title 15.1, Code of Virginia (1950). (Ord. No. 1973- <br />158., Section 1, 12-18-73) <br /> <br />Section 40-103. <br /> <br />Historical or architectural value, etc., <br />to be considered prior to issuance of <br />Certificate of Appropriateness for de- <br />molition. <br /> <br /> Before a Certificate of Appropriateness is issued by <br />the commission, upon conferring with the applicant for the <br />permit for the demolition of a building or structure in the <br />Historic District, the commission, in addition to other per- <br />tinent factors which m~y be iDvolved in the execution of the <br />purposes and objectives declared in Section 40-92 shall con- <br />sider the .historical or architectural value and significance <br />of the building or structure and its relationship to or con- <br />gruity with the land, place and area in the Historic District <br />upon which it is erected and with other buildings or structures <br />therein. <br /> <br />Section 40-104.
