A~ ORDINANCE TO A~,'IEND TI~q~ CODE OF THE CITY OF PORTSMOUTH~ VI~- <br />GIN/A, t973, BY ~2~ENDING SECTION 23-309 THE~EO? PERTAINING TO <br />Tf[E OBLIGATIONS OF A DRIVER TO ~LAKE WT~ITTEN REPORTS OF CERTAIN <br />ACCIDENTS TO POLICE; SUPPLEMENTAL REPORTS; REPORTS BY WITL~ESSES. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That the Code of the City of PorLsmouth, Virginia, <br />1973, be amended by amending Section 23-309 thereof, such ~mend- <br />ed section to read as follows: <br /> <br />Sec. 23-309. Driver to make report of certain accidents <br /> to police; supplemental reports; reports <br /> by witnesses. <br /> <br /> (a) The driver of a vehicle involved in an accident result- <br />ing in injury to or death of any person or total property damage <br />to an apparent extent of two hundred fifty dollars ($250.00) or <br />more shall, within five (5) days after the accident, make a writ- <br />ten report of it to the police department. <br /> <br /> (b) The chief of police may require any driver of a vehicle <br />involved in any accident of which report must ~e made to file a <br />supplemental report whenever any report is insufficient in his <br />opinion and he may require witnesse~ of accidents to render re- <br />ports to the police department. A wilful failure Lo file the <br />report required in this section shall constitute a misdemeanor <br />and shall be punishable under section 23-23. <br /> <br /> (c) The driver of a motor vehicle involved i~ any accident <br />of which report must be made shall execute in detail that portion <br />of the accident report relating Lo the certification of insurance <br />or bond if there was mn effect at the time of the accident with <br />respect to the motor vehicle involved: <br /> <br />(1) <br /> <br />A standard provisions automobile liability policy in <br />form approved by the state corporation commission and <br />issued by an znsurance carrier authorized to do busi- <br />ness in this state or, if the motor vehicle was not <br />registered in this state or was a motor vehicle which <br />was registered elsewhere than in this state at the ef- <br />fective date of the policy, or at its most recent re- <br />newal, an automobile liability policy acceptable to that <br />commission as substantially t~.e equivalent of a standard <br />provisions automobile liability policy; provided, in either <br />event, that every such automobile liability policy is sub- <br />ject to the limits provided in Code of Virginza Section <br />46.1-504. <br /> <br /> <br />
