(2) After June 30, 1973, and prior to July 1, 1975, and after the completion of ten (!0) years of creditable service, or (3) After June 30, 1975~ and after the completion of five years of creditable service~ and who has attained the age of sixty (60) may retire at any time then or thereafter under the provisions of subsection (a) of this section~ except that the re- quirement for the m~mber to be in service shall not apply. That Section 31-63(a) (2), (c), (e), Code of the City of Portsmouth, Virginia~ be amended and reordained to read as ~ollows: (a) (2) With respect to any allowance payment falling due after the members normal retirement date, the larger of: (i) one and thirty-five one hundredths percent (1o35%) of his average final compensation multiplied by the n~mber of years of his creditable service; or (ii) the excess of (x) t%~o percent of his average final compensation multiplied by the number of years of his creditab!e service, not in excess of forty (40) such years over (y) two percent (2%) of the annual amount of the primary social security benefit commencing at his normal retirement date to which he is or would have been entitled at his normal retirement date multiplied by the number of years of his creditable ser- vice, not in excess of twenty-five (25) such years. (c) Upon his retirement as provided in subsection (c) of Section 31-62, on or after July 1, 1973, a member shall receive an annual retirement allowance Dayabie monthly to him during his lifetime the amount of which% before and after his normal retirement date, shall be determined in accordance with either subsection (a) or subsection (b) of this section, which- ever is applicable, except that if the member terminated service as an employee prior to July 1, 1975, and has completed less than twenty (20) years of creditable service~ the al!o.wance as computed shall be reduced to a percentage of itself in accordance with the following table: Complete Years of Credited Service Appiicab~e Percentage Ten (!0) but less than eleven (ii) 50% Eleven (11) but less than twelve (12) 55% Twelve (12) but less than thirteen (13) 60% Thirteen (13) but less than fourteen (14) 65% -3-
