AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- GINIA, 1973, BY ~END!NG SECTION 40-76 OF SAID CODE PERTAINING TO USES PERMITTED WITHIN THE OFFICE RESIDENTIAL OR-75 DISTRICT. BE IT ORDAINED by the Council of the City of Ports- mouth, Virginia: 1. That Section 40-76 of the Code of the City of Portsmouth, Virginia, 1973, be amended and reordained to read as follows: Section 40-76. Office Residential OR-75 District Uses (a) Within the Office Residential 0R-75 District, the following uses are allowed: Accessory uses and structures incidental to any per- mitted residential user such as servants' quarters~ garages, greenhouses or workshops, provided that none shall be rented or occupied for gain, that no accessory building shall be inhabited by other than employees of the owner, lessee or tenant of the pre- mises, provided that no accessory building to be used for living quarters shall be constructed upon a plot until the construction of the principal build- ing has been commenced° Agencies and offices rendering specialized services in the professions, finance~ real estate and broker- age, including, service agencies not involving on- premises retail or wholesale trade, nor maintenance of a stock of goods for saie to the general public° Apothecary shop operated as a retail use within a building, the primary use of which is for a hospital, clinic, or physicians' offices, provided, that said apothecary shop shall sell only drugsf prescription medicines (both ethical and proprietary, medicinal supplies and appliances and pharmaceutical products; and provided further, that not more than fifty (50) per cent of the ground floor area of such building shall be used for such apothecary shop.
