AN ORDINANCE CLOSING A PORTION OF WESTMORELAND AVENUE BETWEEN COUNTY STREET AND COLUMBIA STREET (S-75-3). WHEREAS, David John Noland and Rebecca K. Noland have made application to vacate, close and discontinue the hereinafter described portion of Westmoreland Avenue; and WHEREAS, by resolution of this Council, adopted January 27, 1976, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of the said street, and to report in writing whether, in their opinion, any, and if any, what inconvenience would result from discontinuing the below described street; and WHEREAS, said viewers have reported in writing that, in their opinion, no inconvenience would result from closing and discontinuing said street. NOW, THEREFORE, BE IT ORDAINED bY the Cou~acil of the City of Portsmouth, Virginia, that a portion of Westmoreland Avenue between County Street and Columbia Street as hereinafter described, be closed and vacated as a public street. Ail that certain piece or parcel of land situate in the City of Portsmouth, Virginia, being that portion of the street kno~n as Westmoreland Avenue, formerly Lawrence Avenue, shown on the plat of PortsmOuth Surbaban and Investment Company, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Map Book 4, page 94, said portion lying between the south line of County Street and the north line of Columbia Street, as shown on said plat. BE IT FURTHER ORDAINED that the whole of the portions so closed shall be expressly subject to an easement reserved unto the City of Portsmouth, for the construction, maintenance and repair of water mains, sewer mains, gas mains and storm drainage facilities.
