AN ORDINANCE CLOSING A PORTION OF WILCOX AVENUE, WESTWARD FROM ITS INTERSECTION WITH LANSING AVENUE (S-76-1). WHEREAS, Enoch Carrington and Foundation Boys' Academy, have made application to vacate, close and dis- continue the hereinafter described portion of Wilcox Avenue; and WHEREAS, by resolution of this Council, adopted January 27, 1976, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter described portion of the said street, and to report in Writing whether in their opinion, any, and if any, what inconvenience would result from discontinuing the below described street; and WHEREAS, the said viewers have reported in writing that, in their opinion, no inconvenience would result from closing and discontinuing said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that a portion of Wilcox Avenue, westward from its intersection with Lansing Avenue, as hereinafter described, be closed and vacated as a public street. Ail that certain property beginning at the southwest corner of Lansing Avenue and Wilcox Avenue; thence westerly along the southern boundary line of Wilcox Avenue to the property owned by Foundation Boys' Academy, Inc.; thence northwesterly along the property line of the property owned by Foundation Boys' Academy, Inc. to the northern boundary line of Wilcox Avenue; thence easterly along the northern boundary line of Wilcox Avenue to the northwest in- tersection of Wilcox Avenue and Lansing Avenue; thence southerly to the point of beginning as shown on City Tax Plate 111. BE IT FURTHER ORDAINED that the whole of the portion so closed shall be expressly subject to an easement reserved unto the City of Portsmouth, for the construction, maintenance and repair of water mains, sewer mains, gas mains and storm drainage facilities.
