~N ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1973, BY AMENDING SECTION 5-3 THEREOF, PERTAINING TO <br />MANNER OF REGISTRATION OF BICYCLES AND SECTION 5-12 THEP~OF, <br />PERTAINING TO PENALTIES. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That Section <br />Portsmouth, Virginia, 1973, <br />read as follows: <br /> <br />5-3 of the Code of the City of <br />be amended and reordained to <br /> <br />Section 5-3. Manner of registration. <br /> <br /> Every person engaged in the business of buying, <br />selling, exchanging or trading new or used bicycles shall: <br /> <br /> (!) Register the bicycle on forms prescribed by <br />the Commissioner of Revenue and affix a license decal pre- <br />scribed by the Commissioner of the Revenue in a conspicuous <br />place on that part of the bicycle frame into which the seat <br />is fitted or such other place as may be designated by <br />the Commissioner of the Revenue before sale is consumated; or <br /> <br /> (2) Provide to the Commissioner of Revenue the <br />name and address of the purchaser and the serial number of <br />the bicycle purchased, if such serial number is available, <br />together with the hereinafter prescribed registration fee <br />within 30 days from the date of the sale. <br /> <br /> Registration fees prescribed in Section 5-5 of <br />this Article shall be collected by such person, held in <br />trust and paid to the Commissioner of Revenue. Provided <br />such person may charge a service fee of ten (10%) percent <br />for all registration fees collected. <br /> <br /> The registration of all other bicygles shall be <br />upon written application therefor made to the Commissioner <br />of Revenue on forms prescribed by him. Such forms shall <br />be distributed to the public by such persons and business <br />establishments designated by the Commissioner of Revenue. <br />Written application shall be made by the owner of the <br />bicycle, if over the age of eighteen. The completed appli- <br />cation shall be delivered to the Commissione~ of Revenue <br />or mailed with the registration fee hereinafter provided <br />to the Commissioner of Revenue. After approval of the <br />application, the Commissioner of Revenue shall issue to <br />such applicant a registration card and also a decal in a <br />form prescribed by him.
