Such bond shall be filed prior to the issuance <br />of an excavation permit with the City Attorney. <br /> <br />(6) Lapse; Transfer to Excavation Use Permit: <br /> <br />(7) <br /> <br />(8) <br /> <br />(a) <br /> <br />In the event that the use permit is not exercised by <br />the applicant within one year from the date of its <br />approval by City Council, such permit shall be deemed <br />to have lapsed and be null and void. <br /> <br />(b} <br /> <br />No excavation use permit issued hereunder may be <br />transferred to another person without approval by <br />the City Council; such approval to be granted in <br />the same manner as the original application. <br /> <br />Registration of Existing Excavation: Within ninety days of <br />the enactment of this chapter, the owner of record of any <br />excavation in the City from which material is being sold as <br />excavated material shall be required to file an application <br />of registration. The owner of any project in which such ac- <br />tivity is being conducted shall submit to the Director of <br />Planning, or authorized agent, the following information: <br /> <br />(a) <br /> <br />Identification plat, prepared by an engineer or land <br />surveyor certified by the Commonwealth, drawn to a <br />scale of not less than one inch equals one hundred <br />feet, submitted in five copies. <br /> <br />(b} <br /> <br />A reasonable estimate of acres that have been excavated <br />and the number to be excavated. <br /> <br />(c) Date of inception of operation. <br /> <br />(d) Name of owner of land. <br /> <br />(e) Name of operator of excavation. <br /> <br />(f) Staged and final contours. <br /> <br />Fee for Removal of Excavated Material: The owner or operator <br />of each borrow pit permitted under this chapter shall pay, in <br />addition to any other license or fee, six and one-half cents <br />for each cubic yard of material removed and sold under terms <br />of contracts. An affidavit listing all existing contracts <br />with copies of the same shall be filed with the City Treasurer <br />and the Commissioner of Revenue by the person or persons res- <br />ponsible for this fee on or before July 1, 1977t the date <br />which this levy shall go into effect. <br /> <br />The owner or operat6r shall make application in writing to <br />the Commissioner of Revenue for a license to excavate. The <br />license shall be obtained in advance each mont~ or portion <br /> <br />-3- <br /> <br /> <br />
