(b) In cases %~here the subject weapon is not to <br />be carried as a concealed weapon, the Chief of Police shall <br />issue the permit to purchase or other~ise acquire subject <br />to the following regulations: <br /> <br /> (1) The applicant shall personally sign and <br />complete a written application for the permit. <br /> <br /> (2) The applicant shall be fingerprinted by <br />the Police Department. <br /> <br /> (3) A report of the police records of the <br />applicant shall be obtained by the Police Department from <br />the Central Criminal Records Exchange of Virginia. <br /> <br /> (4) The applicant shall show a lawful use <br />for the subject weapon. <br /> <br /> (5) When such investigation discloses that <br />the public welfare will be prejudiced by permitting a person <br />of known mental instability or criminal activity involving <br />breach of the peaced such a permit shall not be granted. <br /> <br />8o That Section 21-44 be amended to read as follows: <br /> <br />Section 21-44. Dealer to forward purchaser's permit to <br /> Police Chief. <br /> <br /> Upon the sale or transfer of any pistol or any <br />weapon of like kind, the dealer shall secure from the <br />purchaser or transferee the permit to purchase or acquire <br />the same and shall forward such permit with appropriate <br />notation of the sale to the Chief of Police by personal <br />delivery or by letter postmarked not later than 11:00 a.m. <br />of the second day following such sale. <br /> <br />9. That Section 21-45 be amended to read as follows: <br /> <br />Section 21-45. Records. <br /> <br /> Ail dealers in pistols or any weapon of like kind <br />shall keep an accurate register of the number and character <br />of such weapons purchased or otherwise acquired~ the <br />na~e of the person from whom purchased or otherwise acquired <br />and the date thereof and shall likewise keep an accurate <br />record of each sale or transfer of such weapon, which shall <br /> <br /> <br />
