AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF H~ILTON AVENUE W~ICH LIES TO THE SOUTHEAST OF ITS INTER- SECTION WITH MOUNT VERNON AVENUE AND TO THE NORTH AND WEST OF FREDERICK BOULEVARD. (S-76-18). ~EREAS, Jean M. Davis has made application to vacate, close and discontinue the hereinafter describe~ portion of a certain street; and WHEREAS, by Resolution of this Council adopted July 27, 1976, viewers were appointed pursuant to Section 15.1-364~ Code of Virginia, 1950r as amended, to vie%v the hereinafter described portion of said street, and to report in writing whether in their opinion any, and if any, what inconvenience would result from discontinuing the below described street; and WHEP~AS, the said vie~.~ers have reported in writing that in their opinion no inconvenience would result from the closing and discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that that portion of said street hereinafter described, be closed and vacated as a public street: Ail that portion of Hamilton Avenue which lies to the southeast of its inter- section with Mount Vernon Avenue and to the north and west of Frederick Boulevard. BE IT FURTHER ORDAINED that the same is hereby closed and vacated as a public street, that the City of Portsmouth, Virginia reserves unto itself perpetual east- ments, rights and privileges to install, maintain, .operate and replace gas mains, sewer mains, sewer drains, sanitary sewers, storm drains, water mains and lateralsz and electric power lines, within, over, under and across those portzons of Hamilton Avenue heretofore described.
