Section 21-140. <br /> <br />Removal or alteration Df identification <br />numbers or household electrical appiicances; <br />possession of such appliances for purpcses <br />of resale. <br /> <br /> No person, firms a~sociation or corporation~ either <br />individually or in association with one er more other perseus, <br />firms, associations or corporations shall remove, change or <br />alter the serial number or other ~denhification number stamped <br />upon, cut into or attached as a eermanenu cart of any household <br />electrical or electronic appliance where such number was <br />stamped upon, cut into or attached to such appliance by the <br />manufacturer thereof~ <br /> <br /> No persons firm, association or coreoration shall <br />knowingly have in his or its possession for the purpose of <br />resale or keep in his possession for a eeriod in excess of <br />forty-eight hours without reporting such possession to the <br />appropriate law-enforcement agency in the city a household <br />or electrical or electronic appliance, with knowledge that <br />%he serial number or other identification number has been <br />removed~ changed or altered~ <br /> <br /> Any person, firm, association or corporation violating <br />the provisions of this section shall be guilty of a Class 1 <br />misdemeanor. <br /> <br />Section 21-148.1o Civil action for convzction under 21-147. <br /> <br /> Any person who has been convisted of violating the <br />provisions of ~2!-!47 shall be c[viity liable to the owner <br />for the retail value of any goods and merchandLse illegally <br />converted and not recovered by the owner, and for all costs <br />incurred in prosecuting such person under the provisions of <br />§21-147. Such costs shall be limited to actual expenses; <br />including the base wage of one employee acting as a wztness <br />for hhe City and suit costs. Provided, however, nhe total <br />amouunt of allowable costs granted hereunder shall no% ex- <br />ceed ?wo Hundred Fifty Dollars {$250~00) ~ excluding the <br />retail value of the goods and merchandise. <br /> <br />Section 21-!49o1~ Detention of suspected shoplifter. <br /> <br /> A merchant, agent or employee of the merchant~ <br />has probable cause to believe that a -~erson has shoplifted in <br />violation of 21.~144 or 21-147 of this Code or 18.2-95 of the <br />Code of Virginia, t950~ as amended, on the premises of the <br />merchant~ may detain such person for a ~eriod not to exceed <br />one hour pending arrival of a law-enforcement officer. <br /> <br />5 <br /> <br /> <br />
