AN ORDINANCE CLOSING A PORTION OF LONDON BOULEVARD EXTENDING <br />APPROKIMATELY 335 FEET EAST TO THE SOUTHERN BRA2~CH OF THE <br />ELIZABETH RIVER FROM ITS INTERSECTION WITH WATER STREET AND <br />HAVING A RIGHT-OF-WAY WIDTH OF APPROXIMATELY 60 FEET° <br /> <br /> WHEREAS, the City of Portsmouth has made appli- <br />cation to vacate~ close and discontinue the hereinafter <br />described portion of a certain street~ and <br /> <br /> WHEREAS~ by Resolution of this Councilr adopted <br />June 8, 1976, viewers were appointed pursuant to Section <br />15.1-364, Code of Virginia, 1950. as amended~ to view the <br />hereinafter described portion of said street and report <br />in writing whether in their opLnion~ any~ an~ if any~ what <br />inconvenience would result from discontinuing the below <br />described street; and <br /> <br /> WHEREAS~ the said viewers have reported in writing <br />that in their opinion, no inconvenience would result from <br />the closing and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of <br />the City of Portsmouth, V~rginia, that the following street <br />be closed and vacated as a public street: <br /> <br /> All that certain parcel of land, lying <br />and being in the City of Portsmouth. Virginia, <br />and comprising that portion of London Boule- <br />vard extending approximately 335 feet east to <br />the southern branch of the Elizabeth River <br />from its intersection with Water Street and <br />having a rzght of way width of approximately <br />60 feet. <br /> <br /> AND BE IT FURTHER ORDAINED that the same are <br />hereby closed and vacated as public streets, that the City <br />of Portsmouth, Virgmnia, reserves unto itself perpetual <br />easements, rights and privileges to install, maintain~ <br />operate~ and replace gas mains~ sewer mains~ sewer drains~ <br />sanitary sewers, storm drains, water mains and laterals~ and <br />electric power lines~ withinr over, under and across those <br />portions of London Boulevard and Water Street heretofore <br />described; the City of Portsmouth further reserves unto it- <br />self the perpetual easement, right-of-way and privileges of <br />ingress and egress to that portion of London Boulevard occupied <br />Dy the Lightship Portsmouth for the purpose of maintenance~ re- <br />pair and operation of said Lightship as a museum attraction~ <br /> <br /> <br />
