AN ORDIk~NCE TO AMEND THE CODE OF THE CIT~ OF POR/~4OUrH, VIRGINIA, 1973, BY ADDING AI~ICLE XIII, SECTIONS 23-500 THROUGH 23-515 TO CHA~t~R 23 5~4EREOF; PERIgJNIk~ TO MOTOR BOATS AND WA'±'a~ CPAFT SAFETY PROVISIONS. BE IT ORDAINED by the Council of the City of Portsmouth, Virgiuia: t. That the Code of the City of Portsmouth, Virginia, 1973, be amended by adding Article XIII, Sections 23~500 through 23-515 to Chapter 23 thereof, to read as follows: Section 23-500. ~ffling device required on motor bo~ts. The exhaust of every internal cc~bustion engine used on any motor boat on the waters within the city shall be effectively muffled by equipment so constructed and used so as to muffle the noise of the exhaust in a reasonable manner. The use of cutouts is prohibited, except for motor boats cc~peting in a regatta or boat race approved as provided in Section 23-504, and for such motor boats while on trial runs, during a period not to exceed forty-eight hours ~ately preceding such regatta or race and for such motor boats while compet4ng in official trials for speed records during a period not to exceed forty-eight hours in%mediately following such regatta or race. SeD~i~r~23-501. Water skiing, surfboarding, etc. - Observer or life preserver required. It shall be unlawful for any person to operate a motor boat on any of the waters in this city for towing a person or persons on water skis, surfboard or other similar device %~nless there is in such motor beat, a person, in addition to the operator, in a position to observe the progress of the person or persons being towed, or unless the skier or ~ wears a ] ife preserver or ski belt. Section 23-502. Same - Prohibited during certain hours. It shall be unlawfu~ for any person to operate a motor boat on any waters in this city towing a person er persons on water skis, surfboard or other similar device, between the hours frc~ one hour after sunset to one hoar before sunrise, and it shall be unlawful for any person to engage in water skiing or other similar activity on any of the %raters in the city during these hours; provided, however, that the provisions of secuion 23-501 and this section shall not apply to a performer engaged in a professional exhibition or to a person or persons engaged in an activity authorized by Section 23-504.
