A~N ORDINA~NCE TO A~END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY AM~I~DING SECTIC~ 33-56 THEREOF, PER~AIAriNG TO OFF-SITE DPJ~INAGE. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, be amended <br />and reord~ined to read as follows: <br /> <br />Section 33-56. Off-Site Drainage. <br /> <br />I. New Development. <br /> <br /> t. Building. p~rmit will be issued by the Building Official <br />for proposed construction of new development only after the City Engineer <br />has dete3a/kined that the additional off-site drainage flow frc~ such <br />proposed construction will rat be a danger or hazard to an existing off- <br />site drainage facility or property in the proposed construction's drainage <br />basin. (Off-site drainage facilities are those facilities outside the <br />property limits of proposed construction necessary to carry drainage <br />flow frc~ such construction to a drainage basin). New open ditches or <br />modification of existing ditches will not be permitted in areas zoned <br />residential unless included in the City's master drainage plan. <br /> <br /> 2. The City Engineer will determine v~ether a hazard or <br />danger exists frc~ such additional off-site drainage flow by approved <br />drainage computations furnished to the City Engineer by the permit <br />applicant in accordance with the City's Master Drainage Plan, existing <br />field conditions, and zoning required by City Council. Cu~utations <br />shall be based on a nonm%l storm return period of five (5) years using <br />U. S. Department of ~ce ~ and utilizing applicab~e existing <br />Master Drainage Plans on file in the Office of the City Engineer, or as <br />adjusted by the City. <br /> <br /> 3. After the City Engineer deternfunes no hazard or danger <br />results frc~a additional off-site drainage flow, the Building Official <br />will issue a building permit if other required legal mandates are met. <br /> <br /> 4. When the City Engineer determines that a hazard or danger <br />results frc~ additional off-site drainage flow, and all other legal <br />mandates are met, the building permit will be issued only after: <br /> <br /> (a) A plan is submitted by the permit applicant to <br />provide the off-site drainage and is approved by the City Engineer and <br />the permit applicant agrees to construct such approved off-site drainage <br />pursuant to the procedures set out in §33-55 of this Code. <br /> <br /> <br />
