AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSM0~H, VIRGINIA, <br />1977, BY AMENDING ARTICLE III OF CWCHA~£~ 25, THEREOF, PERTAINING TO <br />SOLICITATIONS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the City of Portsmouth, Virginia, that Article III of <br />Chapter 25 of the Code of the City of Portsmouth, Virginia, 1973, be <br />amended to read as follows: <br /> <br />ARTICLE III. Solicitations <br /> <br />Section 25-31. Definitions. <br /> <br /> Unless a ~3_fferent meaning is required by the context, the following <br />tenms as used in this chapter shall have the meaninqs hereinafter re- <br />spectively ascribed to them: <br /> <br /> (1) "Charitable organization". Any person which is or holds <br />itself out to be organized or operated 'for any charitable pu_~pose, or <br />any person which solicits contributions frc~ the public. This 8ef~nition <br />shall not be deemed to include any church or convention or association <br />of churches, pr~narily operated for non-secular purposes and not ps_vt of <br />the net incc~e of which inures to the direct benefit of any individual; <br />nos shall it include any political party as defined in Section 24.1, <br />Code of Virginia, 1950, as ~ed, or any political cc~r/tbee required <br />by local, State or Federal law to file a report or ~ta%~nt of contributions <br />and expenditures; nor shall it include any l~r union registered under <br />Section 40.1-76, Code of Virginia, 1950, as an~nded, nor any trade <br />association, by authority Of such organizatiOn, solely on bed/a3~ of a <br />registered or exempt charitable organization or on k~r~3nf of an organization <br />excluded frc~ tb~ definition of charitable organization. <br /> <br /> (2) "Charitable purpose". Any charitable, benevolent, humane, <br />pkilantropic, or eleemosynary purpose and the purposes of influencing <br />legislation or influencing the actions of any public official or instigating, <br />prosecuting, or inter~oiug in litigation. <br /> <br /> (3) "Contribution". Any gift, bequest, devise or other grant or <br />any money, .credit, financial assistance or property of any king of <br />value~ including the prc~ise to contribute, ex,pt pa].~_nts by the <br />membership of ~n organization for msmbership fees, dues, fines, or <br />assessments, or financial assistance or property received from any <br /> contribution ~2nall not include any <br />gov~tal authority.
