AN GRDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY AM~k~ING SECTION 32-60.4; PERTAINING .TO EROSION AND SEDIMENT <br />CONTROL. <br /> <br />BE IT ORDAINSD by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. ~hat Section 32-60.4 of the Code of the City of Portsmouth, <br />1973, be amended to read as follows: <br /> <br />Section 32-60.4. N~n-Controlled Activities. <br /> <br /> In no instance shall the provisions of this ordinance be construed <br />to apply to the following: <br /> <br /> (1) Such minor land disturbing activities as home gardens and <br />individual hc~e landscaping, repairs and maintenance work; <br /> <br />(2) Individual service connection; <br /> <br /> (a) Construction, installation or maintenance of electric and <br />telephone utility lines; <br /> <br /> (b) Installation, maintenance or repair of any underground <br />public utility lines when such activity occurs on an existing hard <br />surfaced road, street or sidewalk provided such land disturbing activity <br />is confined to the area of the road, street or sidewalk which is hard <br />surfaced. <br /> <br /> (3) Septic tank lines or septic drainage fields unless included in <br />an overall plan for land disturbing activity relating to construction of <br />the building to be served by the septic tank system; <br /> <br /> (4) Surface or deep mirking, tilling, planting or harvesting or <br />agricultural, horticultural, or forest crops; or clearing and trans- <br />porting or privately owned, occupied or operated agricultural, horti- <br />cultural, or forest land; <br /> <br /> (5) Construction, repair or rebuilding of the tracks, right of way <br />bridges, cc~nunication facilities and other related structures and <br />facilities of a railroad c~Lgany. <br /> <br /> (6) Preparation for single-family residences separately built; <br />unless in con~unction with multiple construction in a subdivision <br />development; <br /> <br /> (7) Disturbed areas for cGE~rcial or noncc~uercial uses of less <br />than ten thousand (10,000) square feet in size; <br /> <br /> (8) Installation of fence, billboard and sign posts or telephone <br />and electric poles and other kinds of posts or poles; <br /> <br /> <br />
