A~ ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTS~IOUTIt, VIR- <br />GINIA, 1973, BY ADDING THERETO SECTION 40-45.1, PERTAINING TO <br />REDUCTION OF OFF-STREET RARKING REQUIR~NTS=FOR HOUSING FOR <br />THE ELDERLY. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the Code of the City of Portsmouth, 1973, be <br />amended by adding Section 40-45.1 thereto, to read as follows: <br /> <br />Section 40-45.1. <br /> <br />Reduction of Off-site Parking <br />Requirements for Housing for <br />the Elderly. <br /> <br /> The required parking spaces for multi-family dwellings <br />may be reduced when such housing is designated exclusively as <br />housing for the elderly as defined in this Code, when permit- <br />ted by resolution of the Planning Commission subject to the <br />following conditions: <br /> <br />(a) <br /> <br />No such reduction shall be authorized except upon <br />assurance satisfactory to the Planning Co~mission <br />that such housing will be used by families in which <br />the head of the household is 62 years of age or over. <br /> <br />(b) <br /> <br />No such reduction shall be authorized if more than <br />10% of the total number of persons housed on the <br />premises are employees on the premises, without re- <br />gard to age. <br /> <br />(c) <br /> <br />No such reduction shall be authorized except upon a <br />finding by the Planning Commission that in view of <br />the location of such housing, the economic status of <br />the anticipated occupants and other pertinent con- <br />siderations, reduction in the required number of off- <br />street parking spaces will leave adequate off-street <br />parking for occupants and visitors. In no event shall <br />requirements for such off-street parking be reduced to <br />less than one space for each two dwelling units. <br /> <br />(d) <br /> <br />After such reduction of parking requirements shall <br />have been authorized, the premises shall not be used <br />other than for housing for the elderly unless and <br />until compliance with any parking requirements apply- <br />ing to the new use has been made. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held June 28, 1977. <br /> <br />Tesbe: <br /> <br />City Clerk <br /> <br /> <br />
