I RI:ItHA CE HO. <br /> <br />AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIR- <br />GINIA, 1973, BY AMENDING SECTION 23-395 THEREOF, PERTAINING <br />TO MOTOR VEHICLE TIRE TREADS. ~ <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia, that Section 23-395 of the Code of the City <br />of Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 23-395. Tire Treads. <br /> <br /> (a) Every solid rubber tire on a vehicle moved on any <br />highway shall have rubber on its entire traction surface at least <br />one inch thick above the edge of the flange of the entire peri- <br />phery. No vehicle equipped with solid rubber tires shall be <br />operated over any highway in this City unless a permit therefor <br />first is secured from the State Highway Commission. <br /> <br /> (b) No person shall operate a motor vehicle, trailer <br />or semitrailer, registered in Virginia on any highway in this <br />City, if such motor vehicle, trailer or semitrailer is equipped <br />with one or more tires which either (1) when measured in any two <br />.adjacent tread grooves where the tread is thinnest, at three <br /> equally spaced intervals around the corcumference of the tire <br /> and exclusive of "tiebars" by a tread depth gauge calibrated in <br /> thirty seconds of an inch, is found to have tread depth. Of' less <br /> than t%~ thirty~seconds of an inch at-such locations, or (2) when <br /> equipped with tread wear indicators, is found to have such indi- <br /> cators in contact with pavement at any two adjacent grooves at <br /> three equally spaced intervals around the circumference of the <br /> tire. <br /> <br /> (c) This section shall not apply to tires mounted on <br />dual wheels installed on motor vehicles having seats for more <br />than seven passengers (i) operated wholly within a municipality, <br />or (ii) operated by urban and suburban bus lines, which are de- <br />fined as bus lines operating over regular scheduled routes, the <br />majority of whose passengers use the b~ses for traveling a dis- <br />tance of not exceeding forty miles, measured one way, on the same <br />day between their place of abode and their place of work shop- <br />ping areas, or schools.
