AN OP~DIAZAL~/E TO ~ THE CODE OF ~HE CITY OF PO~TF~0UI~H, VIRGINIA, 1973, <br />BY ADD~qG TO C~LAPTER 40 THEREOF SECTION 40-56 PERTAI~rLNG TO PdKSID~XTfIAL <br />PARKIA~ DISTRICTS. <br /> <br /> BE IT O~ by the Council of the Ci-+17 of Po~smou~_h; Virginia, <br />that Chapter 40 of .the Code of the City of Portsmou~2e, Virginia, 1973, <br />be amended by adding Section 40-56 thereto to read as follows: <br /> <br /> 1. In order to reduce or prevent congestion in t/ne public s~reets <br />and to red'ace hazardous traffic conditions resulting from the use of <br />streets withJ_n 8mceas zoned for residential uses foe the parking of <br />vehicles by per~rs usLng districts zoned for cc~me~rcia! or industrial <br />uses; and to provide for adequate light, air, convenience of access e~nd <br />to protect residential districts from polluted air, excessive noise, end <br />trash and refuse~ mhd to protect ~ee resid~us of residential districts <br />from ~easonab!e b'~ens in gaitS_rig access to Lheir residences; and ~o <br />pr~©te effecie~n~f ~n eine maJ=.~ter~_nce of s~eets Ln a clean and safe <br />condi'~ion; and to facilitate the ~reation of a convenient, attractive <br />and b~nious ~-ni~~ 8~ad to presez-vm the value of pro~hy Ln resi- <br />dential districts; and to preserve the safe~-y of children s~nd other <br />pedestrians ~nd to protect against danger ~nd congestion in travel and <br />~-raD%poz~'~ation; and to preserve pea~e, gcod order, cenve~nience, and w~lfare <br />of the i~qabi~nnts of the City, the City Manager is hereby authorized to <br />designate residential parking districts under the following conditions: <br /> <br /> 2. ~.~n. enever the City Manager or his designees shall detezmine that <br />the streets of a p~cular district or discrete port, ion of a' district <br />in which residential uses are permitted and cu~ercial and industrial <br />uses are not pe~tted are being used for parking by the o~=--rators of <br />veblctes while t~he operators of those vehicles are using districts or <br />portions of districts in wkich cc~mercial or industrial uses are permitted <br />and the average number of vehicles perking in such ~ manner is in excess <br />of twenty five (25%) percent of the number of parking spaces on such <br />streets and ti%e total n~aber of spaces actually occupied by any 9~icle <br />exceeds sevem, ty five (75%) percent of the number of spaces on su~ <br />streets on the weekdays of any month, as determined by a surrey, the <br />City Mam. ager or his designee m~y by zl~le, regulation or ora~ar provide <br />for the restriction of parkLng during the ho~s when such use has been <br />found on those streets of those districts or portions of districts found <br />by the sum-~ey to have bee_n so affected. In such cases, the City Manager <br />shall cause appropriate signs giving notice of %/~e restricted parking to <br />be posted on those streets restricting suc/e parking, under t~he conditions <br />established by such order, rule or regulation %~aich shall be applicable <br />to all par ~king except parking by the holders of permits to be gr~nted <br />only under tile following conditions: <br /> <br /> <br />
