(4) Such conditions shall not include mandatory dedication <br />of real or personal property for open space, parks, schools, fire <br />departments or other public facilities not otherwise provided <br />for in Section 15.1-466(f), Code of Virginia. <br /> <br /> (5) Such conditions shall not include payment for or con- <br />struction of off-site improvements except those provided for in <br />Section 15.1-466(j), Code of Virginia. <br /> <br /> (6) No condition shall be proffered that is not related <br />to the physical development or physical operation of the pro- <br />perty. <br /> <br /> (7) Ail such conditions shall be in conformity with the <br />comprehensive plan as defined in Section 15.1-446.1, Code of <br />Virginia. <br /> <br />Section 40-252. Enforcement and guarantee of performance <br /> and conditions. <br /> <br /> 1o (a) The Building Official may require the petitioner <br />of the zoning amendment, his successor or his contractor, to <br />guarantee performance of the conditions approved by Council <br />in an amount and in a manner satisfactory to the City Council. <br />Such guarantee shall be reduced or released bS~ the City <br />Council or its agent upon the submission of satisfactory <br />evidence that performance of such' conditions have been <br />completed in whole or in part. <br /> <br /> (b) Failure to meet all conditions approved by City <br />Councii~ including the guarantee herein provided, shall con- <br />stitute cause to deny the issuance of any of the required use, <br />occupancy or building permits. <br /> <br /> 2. The Building Official in an effort to enforce the con- <br />ditions approved by City Council under authority herein may: <br /> <br /> (a) Bring necessary legal action to insure com- <br />pliance, including fnjunctlon, abatement or other appropriate <br />legal reIief; and <br /> <br /> (b) Order in writing the remedy for any non-compliance <br />of conditions. <br /> <br />Section 40-253. Records° <br /> <br /> The zoning maps will show by an appropriate symbol the <br />existence of conditions attached to the zoning. The Building <br />Official shall keep in his office, and make available for <br />public inspection, a conditional zoning index. The index <br />shall provide ready access to the 'ordinance creating conditions <br />in addition to the regulation provided for in the particular <br />zoning district or zone. <br /> <br /> <br />
