AN ORDINANCE AMENDING THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY CREATING A LIABILITY DEFENSE FUND FOR OFFICERS, EMPLOYEES AND CERTAIN COMMISSION 5~MBERS APPOINTED BY THE COUNCIL OF THE CITY OF PORTSMOUTH. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the Code of the ~ity of Portsmouth, Virginia, 1973, be amended by adding thereto, Section 2-19, to read as follows: Section 2-19. Public Liability Fund. There is hereby created the Public Liability Fund for the benefit of officers, employees and members of commissions established by the City Council of the City of Portsmouth. Such fund shall be used to pay the expense of defending and pay-, ment of claims arising out of the goo~ faith action of such- officers, employees and commissioners within the scope of their duties with the City of Portsmouth. The City Council shall make annual contributions to the Public Liability Fund in the amount of Fifty Thousand [$50,000.) Dollars. If the available balance of said funds should amount to One Million ($1,O00,000.) Dollars or more, the annual contri- bution of the City may be suspended for so.long as the balance of the fund remains One Million ($1,0OO,0OO.) Dollars or more. Any earnings from the investment of available funds of the Public Liability Fund shall be credited to said fund. The City Attorney shall consult with the City Council before authorizing the payment of any claim from said fond in excess of Five Thousand ($5,000.) Dollars. In addition~ the City Attorney shall make a quarterly report to the City Council of all claims paid in excess of Five Hundred ($500.) Dollars. The City Manager is hereby authorized to promulgate rules and regulations governing said Public Liability Fund. 2. This ordinance shall take effect from the date of its adoption.
