AN ORDINANCE CLOSING THE FOLLOWING: ROAD EXTENDED. A PORTION OF CHEROKEE WHEREAS, the Trustees of Olive Branch Baptist Church have made application to vacate, close and discontinue the hereinafter-described portion of a certain road; and WHEREAS, by a Resolution of this Council adopted Feb- ruary 13, 1979, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter-described oortion of said road, and to report in writing whether in their opinion any, and if any, what inconvenience would result from discontinuing the below- described road; and WHEREAS, the said viewers have reported in writing that in their opin!on no inconvenience would result from the closing and discontinuing of said road. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that that portion of said road hereinafter-described be closed and vacated as a public'road. CHEROKEE ROAD EXTENDED Ail that-portion of Cherokee Road extended at the property line of Isadore Wallace, which point is approximat~ely 287 feet east of the point where cherokee Road reduces in size from a 50 foot right-of-way to an 18 foot right-of-way; from said point thence southeasterly 269.39 feet to the line of property of W. L. Holland; thence southwesterly 18 feet to a point; thence northwesterly 264.74 feet to a point; thence northerly 18 feet to the point of origin. BE IT FURTHER ORDAINED that the s~e is hereby closed and vacated as a public road, that the City of Portsmouth, Virginia, reserves unto itself perpetual easements, rights and privileges to install, maintain, operate and replace sewer mains, sewer drains, sanitary sewers, storm drains and gas mains within, over, under and across those portions of the herelnabove-named street.
