(b) The tow book may be maintained and administered by the City M~nager, or he may delegate such ant~bority to the Chief of Police. ~?re term City Manager shall always include the Chief of Police when used in this section unless the context required otherwise. The City Manager may prescribe condi~-ions for tow operators who apply to be included in the tow book~ andhe may also establish rules and regulations ~hich lnust be obeyed by tow operators who ere listed in the tow book. In Dronlulgatir~g such conditions, rules and rec3ulations~ the City Manager may~provlde for the following matters: (1) Compliance with rain/mum safety standards_ (2) Ownership or possession of all equipment and facilities deemed necessary by the City Manager to provide essential t~inq services. (3) A fee schedule promulgated by the City Manager providing for the maxJ/r~ fees to be charged by a ~ow truck qperator for serx~_tees rendered. Such fee schedule shall include a charge of not less than tm'enty-two dollars and fifty cents (22°50) for basic towing servlees and additional charges for necessary services in psrticular cases. The City Manager shall determine whether additional services were necessary in each particular case and approve all fees charged therefor. (4) Maintaining of a business office assessible to patrons during reasonable business hours. (5) Keeping accurate and co~01ete records of all transactions governed by this section. (6) Maintaining proper custody of towed vehicles and their contents. (7) Separate listings for those tow operators who will perfom services only during daytime hours on regular week days and for those tow opera%ors who are willing to perform services during night hours, weekends and holidays. (8) Reasonable sanctions against operators who violate the roles ~nd regulations, including suspension and re~oval frc~a the t~ book; provided, that the operator in question shall receive notice of his de- linquencies and shall have an opportunity to respond before any ren~fLial action is taken. (9) All other rules~ regulations or conditions which are in- cidential to %he guidelines promulgated herein or which are necessary and -proper to i~plement these guidelines.
