AN ORDINANCE CLOSING A PORTION OF SL~,ERS LANE (AVENUE).

<br /> ~AS, t~e Portsmouth Redevelopment And Housing Authority has
<br />made app//cation tO vacate and close and discontinue the hereinafter
<br />described street; and
<br />
<br /> WHEREAS, by a Resolution of~ th~s Council adopted November 13, 1979,
<br />viewers were ~pDointed' pursuant to Section 15.1-364, Code of Virginia,
<br />1950, as amended, to view the hereinafter-described portion of said
<br />Lane fAvenue}, and to 'report in writing whether in their, opinion, any,
<br />and if any, what inconvenience would result frc~ d/scontinuing the bel~-
<br />described-Lane ~Avenue; and
<br />
<br /> WHEREAS, said viewers have reported in writing that in their opinion,
<br />no inconvenience Would result from the closing and discontinuing of said
<br />street.

<br /> NOW, THERF~0RE, BE IT ORDAINED by the Co~cil of the City of ports-
<br />mouth, Virginia, that the following described Lane [Avenuel be closed
<br />and vacated as a-public street.

<br />situate, lying and be3mg in tb~ City of Ports-
<br />· nouth, Vir~in%a, known and designated as Sumlers
<br />Lane ~Avenue~' as shown on .that certain plat en-
<br />t3%tled "Plat Showing Survey Of Sumlers Lane To
<br />Be Closed, Po~ttk, Vlrgir~a", dated July 13,
<br />1979, prepared by Robert T. Addison And Associa~e~,
<br />Ltd.,-Surveying-Engineering, Portsmouth, Virg~al ,
<br />a copy of which is attached hereto. [S-79-11~

<br /> BE IT F[IR~ ORDA//qED that the same hereby is closed a~d vacated as a
<br />public street and that the City of Portsmouth, Virginia, reserves unto it-
<br />self a perpetual easement, right, and privilege to install, maintain, operate
<br />and replace gas ~mins, sewer !0ains, sewer drains, sanitary sewers~ stoIm
<br />drains,- water mains and~ laterals, electric power lines and telephone lines
<br />within, over. under or across the hereinabove-descrLbed property.
