AN ORDINANCE f~MENDING SECTION 4-23 and 4-51 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGiNIA~ 1973~ PERTAINING TO DOGS <br />RUNNING AT LARGE AND THE PENALTIES FOR VIOLATIONS OF SECTIONS <br />OF CHAPTER 4 OF THE CITY CODE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 4-23 <br />City of Portsmouth, Virginia, <br />to read as follows: <br /> <br />and 4-51 of the Code of the <br /> 1973, be amended and reordained <br /> <br />Section 4-23. Running at large. <br /> <br /> (a) It shall be unlawful for any person who owns, <br />keeps or harbors a dog or has it in his care, or who acts as <br />its custodian, or permits a dog to remain on or about a <br />premises occupied by him to allow such dog on any public <br />street, alley or square of the City, unless such dog is <br />accompanied by an attendant, and held ~leashed by a responsible <br />person or securely muzzled with a muzzle, the charachter of <br />which shall have been approved by the game warden. <br /> <br /> (b) For purposes of this section, a dog shall be <br />deemed to run at large while roaming, running or self- <br />hunting off the property of its owner or custodian and not <br />under its owners or custodians immediate control as defined <br />above. Any person who permits a dog to run,at large or <br />remain unconfined, unrestricted or not penned up, shall be <br />deemed to have violated the provlszons of this section. <br /> <br />Section 4-51. Violations, penalties. <br /> <br /> (a) Any person who shall violate any provision of <br />Section 4-1 or 4-5 of ~Dhis Code as it pertains to animals <br />and fowlf or shall fa~l to comply therewith, shall severally <br />for each and every such violation or non-compliance, respectively, <br />be guilty of a Class ! Misdemeanor, punishable by a fine not <br />to exceed One Thousand ($1,OO0.) Dollars and/or confinement <br />mn jail not to exceed a term of twelve (12) months. <br /> <br /> (b) Wherever in Chapter 4 of the City Code as it <br />pertains to animals and fowl, or matters related thereto, <br />there is an ordinance of if any act is prohibited or is made <br />or declared to be unlawful, or an offense, or wherever in <br />such Code or ordinance the doing of any act is required or <br />the failure to do any act is declared to be unlawful, where <br />no specific penalty is provided therefor, any person who <br />shall violate same or shall fail to comply therewith, shall <br />severally for each and every such violation or non-conroliance, <br />respectively~ be guilty of a Class 4 Misdemeanor punishable <br />by a fine not to exceed One Hundred ($1OO.) Dollars. <br /> <br /> <br />
