AN ORDINANCE f~MENDING SECTION 4-23 and 4-51 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGiNIA~ 1973~ PERTAINING TO DOGS RUNNING AT LARGE AND THE PENALTIES FOR VIOLATIONS OF SECTIONS OF CHAPTER 4 OF THE CITY CODE. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 4-23 City of Portsmouth, Virginia, to read as follows: and 4-51 of the Code of the 1973, be amended and reordained Section 4-23. Running at large. (a) It shall be unlawful for any person who owns, keeps or harbors a dog or has it in his care, or who acts as its custodian, or permits a dog to remain on or about a premises occupied by him to allow such dog on any public street, alley or square of the City, unless such dog is accompanied by an attendant, and held ~leashed by a responsible person or securely muzzled with a muzzle, the charachter of which shall have been approved by the game warden. (b) For purposes of this section, a dog shall be deemed to run at large while roaming, running or self- hunting off the property of its owner or custodian and not under its owners or custodians immediate control as defined above. Any person who permits a dog to run,at large or remain unconfined, unrestricted or not penned up, shall be deemed to have violated the provlszons of this section. Section 4-51. Violations, penalties. (a) Any person who shall violate any provision of Section 4-1 or 4-5 of ~Dhis Code as it pertains to animals and fowlf or shall fa~l to comply therewith, shall severally for each and every such violation or non-compliance, respectively, be guilty of a Class ! Misdemeanor, punishable by a fine not to exceed One Thousand ($1,OO0.) Dollars and/or confinement mn jail not to exceed a term of twelve (12) months. (b) Wherever in Chapter 4 of the City Code as it pertains to animals and fowl, or matters related thereto, there is an ordinance of if any act is prohibited or is made or declared to be unlawful, or an offense, or wherever in such Code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, any person who shall violate same or shall fail to comply therewith, shall severally for each and every such violation or non-conroliance, respectively~ be guilty of a Class 4 Misdemeanor punishable by a fine not to exceed One Hundred ($1OO.) Dollars.
