AN ORDINANCE AMENDING SECTION 40-93, 40-95 AND 40-102 (B) (9) <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />PERTAINING TO DESIGNATION OF TRUXTUN AS A HISTORIC DISTRICT, <br />AND PERTAINING TO THE DUTIES OF TtIE COMMISSION OF ARCHITECTURDf6 <br />REVIEW. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sec'hion 40-93, 40-95 and 40-102(B) (9) be amended <br />and reordained to read as follows: <br /> <br />Section 40-93. Districts created; boundaries of district. <br /> <br /> In order to execute the purposes and objective declared <br /> in Section 40-92, it is hereby created i~ the City, a district <br /> to be known as the "Historic District". The boundaries of <br /> such districts are shown on the map entitled: "Historic District <br /> which shall be filed and maintained in the same manner required <br /> by Section 40-18 of this. The term "Truxtun Historic <br /> District 1918" is found on the document "PHD-79-1" as adopted <br /> by Resolution of the City Council on August 13, 1979. <br /> <br />Section 40-95. Com/aission of Architectural Review. <br /> <br /> (a) In order to further execute the purposes and objectives <br />declared in Section 40-92 and pursuant to the power granted <br />%o and conferred upon the City, there is hereby created and <br />established a Co~mission of Architectural Review which shall be <br />known as the Co~mission of Architectural review, and hereafter <br />in this article referred to as "Commission~ <br /> <br /> (b) The Co~ission shall consist of seven (7) members <br /> who are citizens of the City. They shall be appointed by the <br /> City Council for terms of office of five (5) years from the date <br /> of appointment; provided that the terms of office of the five <br />(5) members first appointed shall be for one (1), two (2), three <br />(3), four (4), and five ('5) years respectively, and thereafter <br />each member shall be appointed for a term of five (5) years. <br />Of the members first appointed, one~t) of the members of the <br />Commission shall be appointed from at least three (3) nominees <br />mad~ by the Portsmouth Bar Association, one,l) shall be appointed <br />from at least three (3) nominees made by the Tidewater Section of <br />the Virginia Chapter of the American Institute of Architects, one <br />~t) shall be appointed f~om at least three (3) nonimees made by <br /> the Portsmouth Historical Association: one ~_) shall be appointed <br /> from at least three (3) nominees made by the Portsmouth Real <br /> Estate Board; and one ~1) shall be appointed from the City at large. <br /> <br /> <br />
