AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, BY AMENDING SECTION 23-1.1 THEREOF, <br />AND REPEALING SECTION 23-204.1 THEREOF. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> (1) That Section 23-1.1 of the Code of the City of <br />Portsmouth shall be amended and reordained to read as follows: <br /> <br />Section 23-1.1. Penalties for violation of motor vehicle <br /> and traffic laws of this Chapter. <br /> <br /> It shall be unlawful for any person to violate any of <br />the sections of Chapter 23 of the Code of the City of Ports- <br />mouth, 1973~, as amended, and unless otherwise stated, such <br />~iolations shall be punished as follows: <br /> <br /> (1) Traffic infractions prescribed in Section 16.1-69.40:1, <br />Code of Virginia, 1950, as amended, shall be fined pursuant <br />to the procedure and fines mandated in said section. <br /> <br />(2) Other traffic offenses shall be punished: <br /> <br /> (a) The first such violation shall constitute a <br />Class 4 misdemeanor; <br /> <br /> (b) The second such violation within one year shall <br />constitute a Class 3 misdemeanor; and <br /> <br /> (c) The third, or subsequent, violation within one <br />year shall constitute a Class 2 misdemeanor. <br /> <br /> (2) That Section 23-204.1, Code of the City of Portsmouth, <br />1973, is hereby repealed. <br /> <br /> (3) This Ordinance shall take effect from the date of <br />its adoption. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held June 26, 1979. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
