AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />V!RG!NIA~ 1973, BY ~,~NDING SECTION 40~48 ~) RELATING TO <br />DIMENSIONAL REQUIREMENTS FOR DRIVEWAYS AND PAP~KING LOTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-48~) of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and reordained to <br />read as follows: <br /> <br />[4) Dimensional requirements. <br /> <br /> (a~ The city engineer may grant a single exception <br />from the dimensional requirements set out in this section if <br />he deems such exception is necessary to prevent a demonstrable <br />hardship upon the property owner or is in the best interest of <br />public safety. If more than one (1) exception is sought, the <br />Planning Commission must approve such exception. Othe~vise, <br />the following minimal dimensional requirements shall be observed: <br /> <br /> (i) No driveway shall exceed thirty-five (35) <br />feet in width at the property line, nor fifty (50) feet at the <br />curb!ine. <br /> <br /> (ii) No driveway, at the curbline~ shall be located <br />within fifteen (15) feet of the property line of an intersecting <br />street, and in no case nearer than five (5) feet from the end of <br />the curb radius. <br /> <br /> (iii) No driveway shall be located within ten (10) <br />feet, at the curbline, from the line of the adjacent property, <br />except in the Historic District where there shall be no required <br />setback of driveways from adjacent property. <br /> <br /> [iv) Where more than one driveway is provided along <br />a frontage in single ownership, there must be a separation of at <br />least twenty (20) feet at the curbline, and a six (6) inch raised <br />protective curb parallel to the street extending not less than <br />two-thirds ~/3) the length of the island shall be placed inside <br />the property line between the driveway. <br /> <br /> (v) Ail such off-street parking spaces shall be <br />properly paved and maintained in such manner as to permit use <br />thereof at all times. Such parking spaces shall not be reduced <br />in total extent, after their provision hereunder, except upon <br />the approval of the planning commission and then only after proof <br />that the parking spaces provided are no longer needed by reason <br />of a change in use of the premises to which t-he parking facilities <br />are adjunct. <br /> <br /> <br />
