CREDITABLE SERVICE. The term "creditable service~ shall be taken to mean for any member the most recent period of continuous service as an employee rendered by the member plus membership service for which credit is allowed under this chapter; provided, however, that periods before and after periods of unpaid authorized leave shall be included as creditable service but the period of leave itself shall not be credited as creditable service. In addition, under regular service retirement and excluding deferred or vested retirement, one-third (1/3) of unused sick leave as of the effective date of retirement shall be added to creditable service. In no event shall a member's creditable service include any period of service after his attainment of normal retirement age. EMPLOYEE. The term "employee" shall be taken to mean any person regularly employed in the service of the City on a full- time permanent basis and whose compensation_ is wholly paid by the City, and persons holding offices in the City required_ by the Constitution of this State and their deputies~ assistants and employees employed on a full-time permanent basis and ~hose compensa- tion is paid partly by the City and partly by the State; but shall not include any person who is eligible for membership in the Virginia Supplemental Retirement System, the Portsmouth Fire and Police Retirement System or who enters into an agreement with the City for inclusion in a deferred compensation plan which agreement specifically prohibits inclusion in other retirement systems established by the City. An employee shall also be taken to mean any person employed under a grant program who has been regularly employed in the service of the City on a full-time bas~s for a period such that he will have become vested under the conditions as stated in Section_31-62r and whereby such grant program has participated in making the necessary contributions to the system for the full period of the employee's service ~o be credited. In case of doubt, the board shall decide who is an employee within the meaning of this article. EMPLOYER. The term "employer" shall be taken to mean the City or the authority of the City having the power to appoint an employee to office or employment. EXAMINER. The term "examiner" shall be taken to mean the medical examiners provided for in Section 31-23. MEMBER. The term "member" shall be taken to mean any employee who has been included in the membership of the system as provided in Section 31-29, and whose mer~bership has not terminated under the provisions of Section 31-30.
