CREDITABLE SERVICE. The term "creditable service~ shall be <br />taken to mean for any member the most recent period of continuous <br />service as an employee rendered by the member plus membership <br />service for which credit is allowed under this chapter; provided, <br />however, that periods before and after periods of unpaid authorized <br />leave shall be included as creditable service but the period of <br />leave itself shall not be credited as creditable service. In <br />addition, under regular service retirement and excluding deferred <br />or vested retirement, one-third (1/3) of unused sick leave as of <br />the effective date of retirement shall be added to creditable <br />service. In no event shall a member's creditable service include <br />any period of service after his attainment of normal retirement <br />age. <br /> <br /> EMPLOYEE. The term "employee" shall be taken to mean any <br />person regularly employed in the service of the City on a full- <br />time permanent basis and whose compensation_ is wholly paid by the <br />City, and persons holding offices in the City required_ by the <br />Constitution of this State and their deputies~ assistants and <br />employees employed on a full-time permanent basis and ~hose compensa- <br />tion is paid partly by the City and partly by the State; but shall <br />not include any person who is eligible for membership in the <br />Virginia Supplemental Retirement System, the Portsmouth Fire and <br />Police Retirement System or who enters into an agreement with the <br />City for inclusion in a deferred compensation plan which agreement <br />specifically prohibits inclusion in other retirement systems <br />established by the City. An employee shall also be taken to mean <br />any person employed under a grant program who has been regularly <br />employed in the service of the City on a full-time bas~s for a <br />period such that he will have become vested under the conditions <br />as stated in Section_31-62r and whereby such grant program has <br />participated in making the necessary contributions to the system <br />for the full period of the employee's service ~o be credited. <br />In case of doubt, the board shall decide who is an employee within <br />the meaning of this article. <br /> <br /> EMPLOYER. The term "employer" shall be taken to mean the <br />City or the authority of the City having the power to appoint an <br />employee to office or employment. <br /> <br /> EXAMINER. The term "examiner" shall be taken to mean the <br />medical examiners provided for in Section 31-23. <br /> <br /> MEMBER. The term "member" shall be taken to mean any <br />employee who has been included in the membership of the system <br />as provided in Section 31-29, and whose mer~bership has not <br />terminated under the provisions of Section 31-30. <br /> <br /> <br />
