AN ORD/NV~CE TO AMEND THE CODE OF %~HE CITY OF PORTSMOUTh,, 1973, BY <br />_a~{ENDING SECTIONS 23-224, 23-267, 23-290, AND 23-293 THEREOF, PER~-q/xriNG <br />TO ON-STIIEET AND OFF-STREET PARKING VIOLATIONS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsraouth, Virginia: <br /> <br /> t. That Sections 23-224, 23-267, 23-290, and 23-293 of the Code <br />of the City of Portsmouth~ 1973, are-hereby amended and reordained to <br />read as foll~s: <br /> <br />Section 23-224. Police orocedure when vehicle found illegally parked. <br /> <br /> (a) Except where ot~herwise provided, it shall be the duty of each <br />police officer of the city to give to the person o.p~r, ating a motor v_e~_cte <br />illegally parked, a notice, or to attach to the vehicle found so parked, <br />a no%ice to the o%~zner that such vehicle has been illegally parked ~nd <br />ir~struc~ing him to report to the Portsmouth Police DepOt Headquarters. <br />Each person so notified may within seventy-t~o (72) hours from the time <br />when such notice was given or attached to the vehicle, pay the s~n of <br />five dollars ($5.00) for each hour or fraction thereof, durin~ which time <br />such vehicle was zl!egally parked. If the owner of such v~.hicle fall <br />to make such oaymen%lwi~hin seventy-two (72) hours of the time such <br />notice %~s attached to such vehicle, then an additional notice shall be <br />given to such owner and an additional penalty of five dollars ($5.00) <br />shall be charged fori such additional notice. The failure of the owner <br />of such vehicle to pay the penalty for the violation and the five dollars <br />($5.00) for the addi~onal notice within eight (8) days from the date of <br />violation shall render such owner subject to the penalties provided in <br />Section 23-1.1. <br /> <br /> (b) The provisions of subsection (a) of this Section shall not <br />prevent the e~force-ment of the provisions of division 2 of this a~ticle <br />concerning ~ r~wo%~l, ~oundment and sale of rotor vehicles. <br /> <br />Section 23-267. Procedure in case of violation. <br /> <br /> It s!~ll be t_h.~ duty of the police officers of the City, acting in <br />accordance witd~ insbructions issued by the Chief of Police to report: <br /> <br /> (a) The numb~r of each parking meter which indicated that the vehicle <br />occupying t~he parking space adjacent to such parking meter is or has been <br />parked in violation of any of tl%e provisioms of this divismon. <br /> <br />(b) The state ilicense number of such vebic!e. <br /> <br /> (c) The length of time during w~s~ch such vehicle is parked, in vlo- <br />lation of ~ny of the prevmsions of this division. <br /> <br /> <br />
