AN ORDINANCE CLOSING A PORTION OF RUTTER STREET. WHEREAS, Curtis Coan has made application to vacate, close and discontinue the hereinafter portion of Rutter Street; and WHEREAS, bv resolution of this Council adopted June 24, 1980, viewers were appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter- described portion of said street and to report in %~it~ng whether in their opinion any, and if any, what inconvenience would result from discontinuance of the said street; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from the closing and discontinuing of said street. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter-described portion of Rutter Street be closed and vacated as a public street: RUTTER STREET Ail that certain portion of Rutter Street beginning on the West side of Peninsula Avenue approximately 225 feet extended from its intersection with the south right-of-way of Columbia Street; thence west 305.95 feet; thence south- west 1OO feet; more or less; thence southeast 55 feet, more or less; thence east 344.62 feet to the West right-of- way of Peninsula Avenue; thence north along the west right of way of Peninsula Avenue 65 feet, more or less, to the point of beginning. (S-69-6). BE IT' FURTHER ORDAINED that the same is hereby closed and vacated as a public street and that the City of Portsmouth, Virginia, reserves unto itself a perpetual easement, right and privilege to install, maintain, operate and replace sanitary' sewers, sewer drains, sewer mains, storm drains and water mains and laterals within, over, under and across the hereinabove- described street.
