AN ORDINANCE TO AMEND SECTION ll-12(a) AND (b) OF THE CODE <br />OF THE CITY OF PORTSMOUTH, 1973, AS A~NDED, PERTAINING TO <br />PURCHASES AND REQUISITIONS, AND PROCUREMENT OF PUBLIC WORKS <br />AND IMPROVEMENTS CONTRACTS. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br /> 1. That Section ll-12(a) ~nd <br />City of Portsmouth, Virginia, 1973, <br />to read as follows: <br /> <br />(b) of the Code of the <br />as amended, be amended <br /> <br />Section 11-12. <br /> <br />Purchases and requisitions; contracts in- <br />volving City funds; wages in public work <br />or improvement exceeding Fifty Thousand <br />Dollars ($50,000). <br /> <br /> (a) The City Purchasin~'-Agent shall,, under the super- <br />vis~on of .the Director of Finance, purchase all supplies for <br />the City and sell all personal property declared as useless, <br />except the purchase of such supplies and the sale of such <br />personal property for which Council may make other provisions. <br /> <br /> Before making any purchase costing more than TWo Thousand, <br />Five Hundred Dollars ($2,500.) or sale, the City Purchasing <br />Agent shall give opportunity for competition under such rules <br />and regulations promulgated'by the Director of Finance. Such <br />rules shall provide for the right of the City Manager to <br />reject any and all bids and parts of a bid. All advertisements <br />of such bids shall contain a reservation of the right of re- <br />jection. ~iNo purchases shall be made unless the Director of <br />Finance certifies' that funds are available. <br /> <br /> (b) 'Any public work or improvement Costing more th~n <br />Two Thousand, Five ~undred Dollars ($2,500.) shall be awarded <br />to the lowest responsible bidder after public advertisement <br />and competition. <br /> <br /> Ail contracts~ except in cases of emergency, over ~venty- <br />five Thousand, Dollars ($25,000.) for street construction shall <br />be let after public advertising. <br /> <br /> The City Manager shall reserve the right ~o reject any <br />and all bids and all ~dvertisements shall contain such reservation. <br /> <br /> Any contract for public work or ~mprovement costing more <br />than Two Thousand, Five Hundred Dollars ($2,500.), including~ <br />but not limited to street construction, may be awarded by non- <br />competitive negotiation when Council has determined prior to <br />award of such contract, that competition is not feasible. <br /> <br /> <br />
