AN ORDINANCE PROVIDING FOR THE JOINDER OF SUSSEX C©UNTY AS <br />MEMBER OF THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF <br />VIRGINIA. <br /> <br />A <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the City of Portsmouth (the "City") has found <br />and determined and does hereby declare that: <br /> <br /> (a) The cities of Chesapeake, Franklin, Norfolk, <br />Portsmouth, Suffolk and Virginia Beach and the counties of <br />Isle of Wight and Southampton have heretofore created the <br />Southeastern Public Service Authority of Virginia (the <br />"Authority") pursuant to the provisions of the Virginia <br />Water and Sewer Authorities Act, being-Chapter 28, Title <br />15..1, Code of Virginia, 1950, as amended, in the manner and <br />for the purposes set forth therein. <br /> <br /> (b) The county of Sussex has expressed its desire <br />and does by concurrent resolution determine to become a full <br />and participating member of the Authority. <br /> <br /> (c) The Authority has heretofore expressed its <br />consent to such joinder by resolution duly adopted on the <br />24th day of June~ 1981. <br /> <br /> (d) The City has determined to provide for the <br />joinder of Sussex County as a full and participating member <br />of the Authority in accordance with the provisions of Section <br />15.1-1248 of the Code of Virginia, 1950, as amended. <br /> <br /> (e) The City has complied with the requirements <br />of Section 15.1-1243 of the Code of Virginiat 1950, as ~ended, <br />by causing this ordinance to be published in a newspaper of <br />general circulation in the City and by holding a duly con- <br />stituted public hearing on the proposed ordinance. <br /> <br /> 2. That upon the joinder of Sussex County, the Authority <br />shall be governed by a Board consisting of one member re- <br />siding in and appointed by the governing body of each of the <br />member political subdivisions and the total number of such <br />members of the expanded Authority shall be nine. The names <br />of the City's initial appointment to membership and the <br />alternate thereto, to become effective upon approval by the <br />State Corporation Commission of Virginia of %he joinder of <br />Sussex County, and the date of expiration of the term of <br />office of the initial appointment to membership are as <br />follow~ <br /> <br /> <br />
