Section 18-64. Rules and regulations. <br /> <br /> Ail residential sales or other sales involving the <br />offering for sale of multiple items of personal property <br />from residentially zoned property, shall be subject to the <br />following rules and regulations: <br /> <br /> (a) No one shall accept or take in for sale any goods <br />from any commercial business or enterprise on a consignment <br />basis. <br /> <br /> (b) No signs shall be posted ~nywhere in the City of <br />Portsmouth advertising such sales except that the property <br />owner may install on the residential lot on which such sale <br />is to be held one sign not larger than four (4) square feet. <br />Said sign shall be posted not more than forty eight (48) <br />hours prior to ~he date of the sale and shall be remove~ at <br />the end of the last day upon which the sale is held. <br /> <br /> (c) Not more than two (2) Such sales per annum shall <br />be held by the same family, or any member of such family, <br />who actually resides within the same residence.. <br /> <br /> (d) Any sale conducted pursuant to the provisions <br />hereof shall be limited in time to the hours of 8:00 A. M. <br />to 5:00 P. M. on three (3) consecutive days. No such sale <br />shall be conducted on Sunday. If the sale is not held <br />because of inclement weather, and an amended application so <br />stating is submitted to the Commissioner of the Revenue, <br />another permit may be ~ssued for a sale date (s)~within <br />thirty (30) days of the original permitted date. <br /> <br /> (e) No personal property sold or offered for sale shall <br />-be placed, kept or displayed on or in any public right-of-way <br /> or in any manner as to interfere with or impede the f~ow of <br /> vehicular or pedestrian traffic. <br /> <br /> (f) The Chief of Police or his duly designated repre- <br />sentative may, when circumstances indicate the existence of <br />or creation of a nuisance or danger to the health, safety or <br />welfare of the public through the conduct of the residential <br />sale, suspend and/or cancel same for a given period of time <br />or for the duration of the date(s) and time allocated in the <br />permit. <br /> <br /> (g) Ail parking of vehicles shall be conducted in com- <br />pliance with all applicable laws and ordinances. Further, the <br />Police Department may enforce such temporary controls to <br />eleviate any special hazards and/or congestion created by the <br />residential sale. <br /> <br /> <br />
