AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, AS AMENDED, BY ADDING TO cHApTER 18 THEREOF, <br />ARTICLE III, PERTAINING TO RESIDENTIAL SALES-INVOLVING <br />MULTIPLE ITEMS OF PERSONAL PROPERTY. <br /> <br /> BE IT ORDAINED ~y the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the Code of the City of Portsmouth, Virginia, <br />1973, be amended, by adding to Chapter 18 there0f,-krticle III, <br />such new Article to read as follows: <br /> <br />ARTICLE Iilo Residential Sales. <br /> <br />Section 18-61. Definit~ons. <br /> <br /> The term "RESIDENTIAL SALE'~, as used in this Article, <br />shall mean th~ sale of personal property'in, at or upon any <br />residentially zoned property. The term residential sale <br />shall include any sale or what is held out to be or is <br />commonly known as a garage, yard, attic, basement, porch, <br />patio, or room sale, or any other type of general sale con- <br />ducted from or on any premises located in a zoning district <br />which does ~ot permit'retail or commercial sales, where <br />goods or articles of ~any type are held out 'for sale to the <br />public. The term residential sale does not encompass the. <br />mere incidential sgte"of one or two items of personal property <br />when such sale is not part of a general sale of a hdmber-6f <br />items of~personal proper'ry. <br /> <br />Section 18-62. General retail sales. <br /> <br /> The conduct of general retail sales or commerd~al sales <br />-or any sales of' mult'iple items of personal property in re- <br />sidential areas of the City is, except as otherwise expressly <br />authorized by law, prokib~ed, <br /> <br />Section 18-63. Permit required; fee. <br /> <br /> Any person conduct±ng a residential sale or other sale <br />involving the 'offering for sale o~ multiple 'items of personal <br />property in, at or upon, any residentially zoned property <br />shall be required to obtain a permit therefor from the <br />CommiSsioner of Revenue. Applications fo~ such permit shall <br />be made to'the 'Commissioner of Revenue in such form as may <br />be required by-the 'Commissioner at least five (5) days prior <br />to the desired beginning date of the ~ale, and shall be <br />accompanied by a permit fee in the amount of five dollars <br />($5.00). The permit must be visible and displayed in a <br />conspicuous place during the time of the sale. Before <br />issuing a permit, tke Commissioner of Revenue may conduct an <br />investigation as may reasonably be necessary to determine if <br />there is compliance With 'thfs Code and to determine the <br />impact the proposed sale would have on the neighborhood in <br />question reIative to the health, safety, and welfare of the <br />public. <br /> <br /> <br />
