AN ORDINANCE AMENDING SECTION 14-5 OF THE CODE OF THE CITY OF <br />PORTSMOU'~q~, VIRGINIA, 1973, PERTAINING TO CHARGES FOR HANDLING <br />REFUSE AT CITY INCINERATOR OR LANDFILL. <br /> <br /> BE iT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> t. That Section 14-5 of ~he Code of the City of Portsmouth, <br />Virginia, be amended and reordained to read as follows: <br /> <br /> (a) Whenever incinerable refuse is brought to the City <br />incinerator by persons other than residents with refuse from <br />their personal premises, a fee of ten dollars and fifty cents <br />(~10.50) per ton, or a minimum fee of six dollars ($6.00) per <br />load shall be charged for the service. <br /> <br /> (b~ Delivery to a City landfill by persons other than <br />residents of the City with refuse from~their personal premises, <br />shall pay a fee of four dollars and fifty cents ($4.50) per ton, <br />or two dollars twen~y-~ive cents ($2.25) per cubic yard or a <br />minimum charge of t~o dollars twenty-five cents ($2.25) per load, <br />whichever is greater. The fee for depositing rubber tires that <br />have not been sli~ed, ct~pped, or othe~.~ise sufficiently deformed <br />to lose their rebounding characteristics in the opinion of the <br />Director of Public Work~ shall be sixteen dollars ($16.OO) per <br />ton. <br /> <br /> (c) Whenever refuse brought by any person to a City in- <br />cinerator or landfill for disposal is of such volume or character <br />as to cause undue expense to the City, the director shall refuse <br />to accept the same unless such person shall agree to pay a <br />ssrvice charge based upon the cost of handling and disposing <br />of such refuse. <br /> <br /> (d) Prior to granting disposal services at the City in- <br />cinerator or landfill to any business or commercial establish- <br />ments, the Department of Public Works may, at the discretion <br />of its Director, require a cash deposit of one hundred dollars <br />($tOO.OO) for each business or commercial landfill user who <br />has not previously established satisfactory credit for such <br />service. At such time of final termination of an account, <br />the deposit will be applied to the final billing and any <br />refund due shall be paid ~o the party entitled to ~the deposit. <br />If any account exceeds the amount oi deposit, the Director <br />of Public Works or his duly authorized representative, <br />shall be authorized to increase the deposit required. After <br />a period of continuous service and satisfactory payment of <br />fees so as to establish satisfactory credit determined by <br />the Director of the Department of Public Works, the deposit <br />may be applied to the respective account. <br /> <br /> <br />
