AN ORDINANCE TO AMEND SECTIONS 32-60.4 and 32-60.7 OF THE <br />CODE OF~THE CITY OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING <br />TO EROSION AND SEDIMENT CONTROL. <br /> <br /> BE IT ORDAINED by the Council <br />Virginia: <br /> <br /> ~.1~ That Sections. 32-60.4 and 32-60.7 of the Code of <br />the~Ci~ of Portsmouth, Virginia, 1973, be amended to read <br />as fo!lows~- ~ <br /> <br />Section 32-60.4. NonControlled A6tivities, Local Erosion <br /> and Sediment Control Program. <br /> <br /> '-~ (a) In no instance shall the provisions <br />be construed to apply to the following: ' ~ <br /> <br /> [1) Such minor land disturbing ac <br />gardens and lndmvldual homy landsc~pzng, repairs <br />work; ~ <br /> <br />of the City of Portsmouth, <br /> <br />and maintenance <br /> <br /> (2) Individual service connections, construction, <br />installation or maintenance of electric and. telephone utility <br />lines, and installation, maintenance or repair of any underground <br />public utility lines when such activity occurs on an~existing <br />hard surfaced road, street, or sidewalk provided such land <br />disturbing activities-is confined to the area of the road, <br />street or sidewalk which is hard surfaced; <br /> <br /> (3) ~ Septic tank lines or septic drainage fields <br />unless included in an overall plan for land disturbing activity <br />relating to construction of the building to' be served by the <br />septic tank system; <br /> <br /> (4) surface or deep mining; nor'exploration or <br />drilling for oil and gas including the well site, roads and <br />off-site disposal areas; tilling, planting or. harvesting of <br />agricultural, horticultural, or f0~es~ 'cro~s; <br /> <br /> (5) ~ ~ Construction, repair or r~building of the <br />tracks, right-of-way bridges, communication facilities and <br />other related structures and facilities of a railroad company; <br /> <br /> (6) Preparation for single-family residences <br />separately built; unless in con]unction with multiple construction <br />in a subdivision development; <br /> <br /> (7) Disturbed areas for connnercial or noncommercial <br />uses of less than hen thounsand (10,000) square feet in size; <br /> <br /> <br />
