AN ORDINANCE TO AMEND SECTIONS 32-60.4 and 32-60.7 OF THE CODE OF~THE CITY OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO EROSION AND SEDIMENT CONTROL. BE IT ORDAINED by the Council Virginia: ~.1~ That Sections. 32-60.4 and 32-60.7 of the Code of the~Ci~ of Portsmouth, Virginia, 1973, be amended to read as fo!lows~- ~ Section 32-60.4. NonControlled A6tivities, Local Erosion and Sediment Control Program. '-~ (a) In no instance shall the provisions be construed to apply to the following: ' ~ [1) Such minor land disturbing ac gardens and lndmvldual homy landsc~pzng, repairs work; ~ of the City of Portsmouth, and maintenance (2) Individual service connections, construction, installation or maintenance of electric and. telephone utility lines, and installation, maintenance or repair of any underground public utility lines when such activity occurs on an~existing hard surfaced road, street, or sidewalk provided such land disturbing activities-is confined to the area of the road, street or sidewalk which is hard surfaced; (3) ~ Septic tank lines or septic drainage fields unless included in an overall plan for land disturbing activity relating to construction of the building to' be served by the septic tank system; (4) surface or deep mining; nor'exploration or drilling for oil and gas including the well site, roads and off-site disposal areas; tilling, planting or. harvesting of agricultural, horticultural, or f0~es~ 'cro~s; (5) ~ ~ Construction, repair or r~building of the tracks, right-of-way bridges, communication facilities and other related structures and facilities of a railroad company; (6) Preparation for single-family residences separately built; unless in con]unction with multiple construction in a subdivision development; (7) Disturbed areas for connnercial or noncommercial uses of less than hen thounsand (10,000) square feet in size;
