AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY A~NDING SECTION 12-46, PERTAINING TO <br />FIRE PREVENTION CODE APPEALS; BY AMENDING SECTION 17-18, <br />PERTAINING TO HOUSING CODE APPEALS; AND BY AMENDING SECTION <br />39-5 PERTAINING TO APPEALS FROM NOTICES TO REMOVE WEEDS AND <br />DEBRIS. <br /> <br /> BE iT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 12-46 of the Code of the City of Ports- <br />mouth, Virginia, 1973, be amended and reordained to read as <br />follows: <br /> <br />Section 12-46. Notice to comply with provisions; compliance <br /> required; appeals to City Manager. <br /> <br /> (a~ In case the C~lief Inspector of the Bureau of Fire <br />Prevention or his assistants finds that any provision of <br />this Chapter or other ordinance pertaining to his duties is <br />not being complied with, he shall give notice in writing to <br />the owners, occupants~ lessees, or persons in possession, <br />charge or control of such structure or place to make such <br />alterations or repairs or to take such action as will cause <br />the structure to conform to the requirements of existing law <br />so far as fire risks or fire prevention ms concerned. Except <br />as provided for in subsection (c) of this section, such <br />notice shall be d0mplied with within fifteen (15) days except <br />in emergency cases where the Chief Inspector or his assistants <br />might require the corrections in a shorter time. <br /> <br /> (b) If the person to whom notice, as provided for in sub- <br />section (a) of this section is sent, shall deem himself aggrieved <br />by such order, he may, within twenty-four (24) hours thereafter, <br />appeal %o the City'Manager. Unless the City Manager reverses <br />that order, it shall remazn in force and shall be forthwith com- <br />plied with by the person to whom the notice was sent. <br /> <br /> (c) Any person to whom notice is sent, as provided for <br />in subsection (a) of this section, may, within the time period <br />set for compliance by the notice, request an enlargement of <br />the time period for compliance from the City Manager or his <br />designee. Where warranted by extenuating circumstances, the <br />City Manager or his designee,may extend the date for compliance <br />for an additional period not to exceed fiftee~ (15) days from <br />the date set for compliance in the original notice. <br /> <br /> 2. That Section 17-18 of the Code of the City of Portsmouth, <br />Virgmnia, 1973, be amended by adding thereto, Section 107 of the <br />S~uthern Standard Housing Code, 1969 Edition, to read as follows: <br /> <br /> <br />
