AN ORDINANCE TO AMEND SECTION 32-19 OF THE CODE OF T~E CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO STREETS AND SIDEWALKS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 32-19 of the Code of the City of Ports- <br />mouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 32-19. <br /> <br />Soliciting subscriptions, selling goods or <br />services or distributing printed matter on <br />certain streets and sidewalks. <br /> <br /> No person shall sell or offer to sell any goods, wares, <br /> merchandise, books, magazines or any article of value, except <br /> newspapers, or take orders for or sell subscriptions to same <br /> for future deliverY, or render or offer' to render any services <br /> other than the shining of shoes, or distribute printed matter <br /> on any of the streets and sidewalks paralleling streets which <br />~are (i) designated as parking meter zones in Section 23-257 or <br /> (ii) within fire districts as set forth in Section 6-9~ such <br /> streets and sidewalks being congested areas for pedestrian <br /> travel and use. <br /> <br /> The prohibition against the sale or distribution of the <br />articles mentioned in the first paragraph of this section shall <br />not be construed as prohibiting: (i) the actual distribution <br />or circulation, without any charge therefor, to the public, <br />of publications, leaflets, pamphlets or any printed or written <br />matter.that disseminates opinion or information or provokes <br />thought or pertains to any religious information or b~lief; or <br />(ii) the City Manager from authorizing, by issuing a permit <br />therefor, sidewalk sales as part of a downtown festival event <br />where it is determined that such event will not be detrimental <br />or injurious to property or improvements in th~ neighborhood, <br />and will not adversely affect the health and safety of persons <br />residing or working in the neighborhood. <br /> <br /> 2. That this ordinance shall take effect from the date <br />of its adoption. <br /> <br /> Adopted by the CoUncil of the City of Portsmouth, Virginia <br />at a meeting~held December 13, 1983. <br /> <br />Teste: <br /> <br />Clerk <br /> <br /> <br />
