WHEREAS the United States Navy Department presently proposes to donate to the City of Portsmouth its property known as Alabama Avenue extending between its housing project known as New Gosport Defense Housing and the westerly right of way line of George Washington Highway, consisting of 1,880 acres, its 8 inch cast iron force sewer main extending from said housing project along Alabama Avenue and George Washington Highway to a point where it connects with the system of the Hampton Roads Sanitation District Commission, together with its sewer pumping station and related facilities, water mains, and storm drains; and WHEREAS the United States Navy Department has requested the formal expression from the City as to its willingness to accept the aforesaid faci- lities subject to certain reservations in the Federal Govsrnment and con- ditions as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED, that the City Manager be and he is hereby authorized to:accept the aforesaid donation at such time as it shall be tendered to him by the United States of America, upon the follow- ing conditions: a) The United States of America shall reserve unto itself and its assigns the necessary easements for existing electrical power lines and gas trans- mission lines. b) The City of Portsmouth agrees upon acceptance of the donation to operate and maintain thereafter, the aforesaid section of Alabama Avenue and the water mains, storm drains, sewer mains, and.sewer pumping stations located therein so that the New Gosport Defense Housing Project will continue to receive uninterrupted street access, sewer, water and other utility services over and through said Alabama Avenue. c) Simultaneously upon acceptance of the donation, the City at its expense will relocate upon government pro- perty at the housing project boundary the water meter owned by the United States of America and presently situate within that portion of Alabama Avenue to be donated to the City.
